  中新社广州10月23日电 (程景伟 全美华)广东省政协23日对外公开的一份调研报告指出,广东近年来大量涌现的草根组织,活动日趋频繁的境外非营利组织(累计超过1600个,插手劳工、人权、环保、基层选举等社会矛盾和热点问题)以及各类网络虚拟社会组织(网上结社)等均未纳入法规调整范围,造成监管真空。


  从2012年7月1日起,除法律法规规定需要前置审批的以外,广东社会组织业务主管单位均改为业务指导单位,由民政部门直接审查登记,此举促进了广东社会组织数量增长。据统计,截至2013年6月底,全省依法登记社会组织共有37973个,其中新登记4200个。


  广东省政协对全省多地调研后发现,广东社会组织改革发展取得很大突破,但法制建设滞后,从国家层面上,目前还没有一部社会组织法,对社会组织在税收优惠、财政资助等缺乏实体性规范,社会组织承接政府转移职能多为政府或部门下发文件,法律效力较低;社会组织管理体制有待改进,目前有些规定甚至与现实相悖,亟需完善和修订。


  调研报告称,建议全国人大将《社会组织法》纳入立法计划,从法律层面明确社会组织性质、作用、法律地位权利义务、管理体制、组织结构、财产权及税收减免等;制定涉外社会组织登记管理法规,把在国内活动的境外非政府组织尽快纳入依法管理轨道。


  报告还指出,广东一些地方政府领导干部怕社会组织没能力,怕社会组织胡来、闹事和惹麻烦等,对其作用缺乏正确的认识;存在难以割舍的行政情结,政府职能转变不到位,“小政府、大社会”格局远远没有形成,政府“大包大揽”思维没有根本性的变化;一些政府部门触及现有利益格局而不愿意放权,转移职能目录还存在“避重就轻”现象。


  报告建议,广东要先行先试,尽快制定《广东省社会组织条例》;制定《广东省社会组织承接政府职能转移条例》增强法律约束力,尽快修改完善《政府采购法》,将政府采购的“服务”扩大到公共服务方面,以适应政府购买社会组织服务需要。(完)
