长期研究劳教制度的重庆大学法学院院长陈忠林向南都记者分析，周强的这一表态，传达出在劳教制度改革中最高法的态度和倾向。
“最高法倾向于用轻罪来取代劳教措施，对于触犯刑律的行为，就直接按照刑事案件来处理；而并未触犯刑律的，则轻罪处理。”陈忠林说，这也是从去年以来在案件裁判中就逐步透出的倾向。
陈忠林表示，可以预期，随着最高法的要求在各级法院得到落实后，将从源头上减少甚至基本取消劳教措施。
