据了解，作案时，李熠是中共麻阳苗族自治县委员会督察室干部；杨凡是麻阳苗族自治县人民法院干部；刘阳是麻阳苗族自治县公安局绿溪口派出所所长。一审宣判后，3名被告人表示不服判决将上诉。据记者旁听一审宣判时的了解，3人辩解和辩护意见主要集中以下几点：
一是认定本案有罪证据系违法收集，证据形式不合法，不能作为认定犯罪的证据；
二是窃听、窃照设备已被被告人杨凡丢弃，现有物证来源不明，定罪证据不足；
三是鉴定机构无鉴定资质、鉴定书形式不合法，检材来源不明，鉴定不能采信；
四是本案没有造成严重后果，不构成犯罪。
对上述辩解和辩护意见，怀化市鹤城区人民法院根据查明的事实、相关物证、鉴定机构出具的鉴定结果、证人证言等一一予以评判，均不予采纳。
据悉，“麻阳偷拍案”3名被告人上诉后，二审将在湖南省怀化市中级人民法院举行。

李熠在供述中表示，2012年2月初，他与杨凡、刘阳在一起用餐时，他提出在胡佳武的办公室安装窃偷拍设备，利用偷拍的视频要挟领导，达到提拔的目的。其余二人均同意，并对偷拍事宜进行了分工协作。
怀化市鹤城区人民法院审理查明的事实中，刘阳对偷拍进行了分工：杨凡负责购买偷拍设备，费用由三人平摊；李熠负责偷配胡佳武办公室的钥匙。接下来，杨凡在武汉市购买了窃听、窃照器材和数枚伪装摄像头的螺帽；李熠、杨凡在麻阳县一家电器专卖店购买了与胡佳武办公室同样型号的“沁园”饮水机一台。随后，李熠、杨凡、刘阳将窃听、窃照器材安装在购买的饮水机内部，将摄像头安放在特制的螺帽内，用胶水固定在饮水机顶盖左侧面。
余下的事情变得很简单：李熠利用偷配的钥匙，与杨凡秘密进入麻阳县委办公楼三楼胡佳武的办公室，将上述安装有窃听、窃照器材的饮水机与胡佳武办公室的饮水机进行替换。
胡佳武的证言表明，2012年10月17日上午，李熠在县委办公楼二楼的值班室，播放了他在办公室与人往来的视频。李熠还称这是自己的两个公安朋友要李熠转交给他的，并问他怎么办。10月18日下午，李熠到他办公室要求将其两个朋友提拔进党委班子，李熠本人想做他的生活秘书，并扬言如果这些想法不实现，就公布偷拍的视频。据新华社

一审宣判后，3名被告人表示不服判决将上诉。但是偷拍的视频内容究竟是什么？这3人当时为何深信手中的偷拍视频可以换来更好的乌纱帽？至今仍是一个谜。
目前，胡佳武的工作和职务并未随着这起案件的发生和一审宣判有任何变更。在麻阳苗族自治县政府网站的“领导之窗”栏目中，胡佳武仍然担任县委书记一职。
一位法律界人士接受记者采访时表示，鉴于这起案件已成为公共事件，在对3名非法偷拍者绳之以法后，有关部门理应介入对偷拍视频内容本身的调查，就公众关心的内容——偷拍的视频内容是否存在违法违纪行为给出一个明确的交代。据新华社
