　　法院审理查明，2004年2月，钦州市政府成立了大风江调水工程建设指挥部。一个月后，该市水利局将工程发包给湖南岳阳市水利水电工程有限公司承建。时任钦州市水利局副局长的被告人林某某担任指挥部成员兼办公室主任。在工程建设过程中，林某某利用负责调水工程的日常管理、征地、纠纷协调、工程施工进度报告和工程付款审批等职务便利，于2005年春节前一天，在其家中收受工程一标段包工头邱某某的人民币5万元，为邱谋取利益。

　　2010年，林某某因受贿被当地相关部门查处。原判钦州灵山县法院依法以受贿罪作出上述判决。宣判后，被告人不服，继续上诉。(完)
