胡万林涉嫌罪名：非法行医还是故意杀人？
昨天，云旭阳案的代理律师张伟接受新京报记者采访时称，目前此案还在侦查环节，家属和律师对此案的质疑目前集中在胡万林所涉罪名上。
据新安县公安局此前向媒体披露，10月1日新安县检察院以涉嫌非法行医批准逮捕了胡万林等4名犯罪嫌疑人。公安机关将案件定性为“非法行医”的主要原因，是参加此次活动的所有人都喝了涉案的不明液体。
张伟则认为，胡万林所涉罪名应为故意杀人罪。因为胡此前曾用芒硝致人死亡，并因非法行医被查处，因此对芒硝的危险性是非常清楚的。这次再次大量使用危险物芒硝，属明知故犯。在云旭阳出现不良反应后，也没有及时救治，对云的死亡，应该存在着较多的放任，使得此案有“故意杀人”嫌疑。
云文超也称，云旭阳身体健康，“他是去学习的，不是去治病的。说胡万林非法行医，我不接受。”
但新安县公安局表示，胡万林的行为实质就是行医，因为其“主观上，不是想置谁于死地。”

23岁大学生痴迷中医拜师入歧途
8月29日中午，漯河市临颍县瓦店镇云庄村。23岁的云旭阳告诉父亲云文超，他“要去洛阳参加中医研讨会，学习中医”。
“我心想孩子去学习中医是件好事，还给他1000元钱。”云文超没有想到“学习中医”却把儿子送上不归路。
9月1日晚上，云文超接到洛阳新安县公安局通知，说云旭阳已经死亡。
痴迷中医
云旭阳是在大二期间迷上中医的。当时他一位同学崴了脚，郑州一家中医诊所给治好了。云旭阳觉得中医很神奇，便拜郑州一位孟姓中医师为师，开始研究中医。
云旭阳尤其痴迷针灸，买了二三十本这方面的书自学，拿着手指长的针往自己腿上、手臂上扎。“我很心疼，他却说要学针灸就得先拿自己做实验。”云文超说。
云旭阳用自学的针灸手艺给奶奶治好了腰疼，“他特高兴，确定自己要学中医，救死扶伤。”云文超说。
2011年，云旭阳退学，在家乡开了中医理疗店，给乡邻治病，一月收入有三四千元。
拜师不顺
云长安是云旭阳的堂哥。他说，云旭阳学中医后“整天就想着针灸的事，闷着头说话也少了。家里人让他相亲，他也不上心。”
云长安记得2012年夏天，云旭阳来找他，吐露拜师不顺的郁闷。“他在网上得知北京有个中医很有名，就跑到北京，天天早上在名医生诊所门前守着，求医生收他做徒弟。一连守了4天，那名医生都没答应，他只好回来了。看得出来他很迷茫。”
云文超说，2012年，云旭阳去外地拜过几次师，但都不满意，情绪也低迷。理疗店没人看管，生意渐渐就差了。
陷入深渊
今年春节，云旭阳到武汉跟一个叫陈永康的人学中医，回来后情绪高涨，“他说找对了师傅，肯定能学好中医。”云文超说。
云长安在云旭阳死后，找到他的网络聊天记录。聊天记录显示，云旭阳在陈永康的介绍下认识胡万林的徒弟秦昌武等人。他们诱骗云旭阳说：“胡万林是神医，什么病都能治，癌症几天就治好。”
云旭阳开始痴迷“胡大师”，在自己的网络空间中大量转载了胡万林的所谓“自然运动健康学”理论。
云旭阳对前途充满信心，他在8月的一篇文章中写道：“未来几年，我的医术会进步得很快，可谓飞速上升。”
8月29日云旭阳前往洛阳参加胡万林等主办的中医研讨会，他的QQ记录显示：“如果这一次我学成了，我就回来给人们免费治病。”但云文超再也没等回儿子。

“当代华佗”胡万林的“行医”路
胡万林1949年生于四川绵阳一个农民家庭，1982年曾因故意杀人罪入狱。
1991年起，没有任何合法行医资格的胡万林在狱中开始看病。他认为所有疾病都源于血脉不通，只要上吐下泻就可将毒素排出，并以芒硝为主料制成治百病的“神药”。
1993年，经监狱管理方批准，胡万林向社会行医。因“扫一眼便可以透视病情”，他很快小有名气。但因经其医治的13名患者先后死亡，1996年，胡万林的行医活动被取缔。
1997年胡万林被提前释放。当年，胡万林在陕西长安县与人合办终南山医院，胡出任法人代表并亲自坐诊，前来终南山医院就诊的患者络绎不绝。

1998年9月，河南省漯河市市长刘法民在服用胡万林开具的加有芒硝的中药水后死亡。刘法民去世两天后，胡的药水又导致一退休教师死亡。
警方随后介入，“调查发现，胡没有任何行医执照”。
1998年年底，胡万林在上海被抓获。2000年9月，商丘市中级人民法院一审以非法行医罪判处胡万林有期徒刑15年，剥夺政治权利5年，并处罚金15万元。
