10月21日下午4时，云文超及云家代理律师张伟到新安县公安局了解情况。该局刑侦大队大队长及三中队中队长李某等办案民警出面进行了接待。
对家属指称的涉案物质系芒硝，李某受访时并未认可，但表示属于芒硝类物质，确切成分仍在进一步调查中。
李某强调，他们的每一步认定，都是十分慎重的。饮用物质方面，他们通过洛阳市公安局协调，委托的是中国化工集团公司下属的洛阳黎明化工研究院作物质鉴定，“因为他们院长是院士，有国家级实验室”。
“结果没出来，我们也很着急，但急不得，你也知道，光做病理毒化，最少20天，包括理化实验、病理切片等，都很耗费时间。”解释尸检报告耗时较长时间时，李某说。
此前的10月10日，新安县公安局已向云文超通报了鉴定意见通知书。
通知书显示，该局对云旭阳死因的鉴定意见是“云旭阳符合饮用含芒硝(类)的液体后引起恶心、呕吐等，合并肠炎和上呼吸道感染导致机体脱水、水电解质平衡紊乱和急性呼吸循环功能障碍而死亡的征象”。
李某透露，即便他们如此慎重、权威的尸检结果，还有犯罪嫌疑人提出质疑，要求重新鉴定，“这个程序正在履行”。
案情通报芒硝类“法物”，参加活动的人都喝了
李某在介绍案情时说，死者和犯罪嫌疑人等人是在8月31日上午10时30分许入住农家宾馆的。
“他们团队总共14个人，参加的学员11人，其中有6名身患各种疾病，其余5人为中医等方面从业人员。”李某说，“挑头的”说，来这里治病有“法物”，“他们都是奔着这个来的”。
张伟插话说“挑头的”就是胡万林时，李某没有否认。
李某说，参加此次活动的所有人都喝了涉案的不明液体，这也是他们将案件定性为“非法行医”的主要原因之一。
张伟提出“这么多人饮用芒硝类物质，但只有云旭阳一人死亡，是不是他喝得多”疑问时，李某表示“有这方面情况”。
问及“喝的东西”是否胡万林配制、胡万林是否认罪等情况，李某以“案件还在侦查阶段，有些情况不方便告知”、“签订有保密协议”为由，婉言谢绝。
案情通报涉嫌非法行医，胡万林等四嫌犯被批捕
对此案众多涉案人员，案发地新安县石井镇的不少村民起初并不认为有多特别，也根本没有与之前因芒硝治病而被誉为“当代华佗”且被媒体热炒的胡万林联系起来。
李某说，此次被逮捕的胡万林，正是之前被柯云路、司马南等名人激烈论争、被媒体广泛报道的“神医”胡万林。
按照他陈述的情况，“胡万林是2011年刑满释放的，他是减刑了，是在洛阳市监狱服的刑。”
李某说，10月1日新安县检察院批准逮捕了4名犯罪嫌疑人。其中，除了胡万林，还有组织者吕伟、唐孟君、贺桂枝。此外，联络人陈永康等人，因大多属于受害人，且没有证据证明参与实施了犯罪，暂未采取相关措施。
“他们并不是一个很具体的组织，没有明确的管理，他们只是在一块，有一个简单的分工，起的作用差不多，属于是共同犯罪，现在已经侦查得差不多了。”李某说。
释疑
批捕胡万林，定性为何是“非法行医”？
焦点案发过程中，死者为何赤身裸体？
据龙潭大峡谷卫生所医生陈小东讲，当晚他接到云成酒家老板李云成电话赶到现场救治时，云旭阳赤身裸体，被人扶着半坐在卫生间地上。
这种赤身裸体的状况，也引发了云家家属的疑惑。
李某解释说，涉案人员喝下芒硝类物质是在案发当天下午，出现不良反应是在晚上约9点到10点之间。“当时，云旭阳本人已经出现狂躁、抽搐等各种反应。”
“他当时没穿衣服，这是出现不良反应后冲凉水澡造成的，按他们的理念，喝完这个后都要冲凉水澡。”他说。
李某还说：“当时还有一个年轻人没有反应，出警民警到达现场一会儿后，才出现呕吐等不良反应，被镇卫生院送到了县人民医院抢救”。
记者获悉，目前，这名此案中唯一被救治康复的男青年，已返回广西，暂时无法联系。
焦点饮用芒硝类物质致死，是否被胁迫过？
根据云文超提供的视频，仍在殡仪馆存放的云旭阳遗体上，脚腕存在外伤，手掌、背部等多处青紫，头部出血较多。据此，云家人怀疑，云旭阳案发前，可能受到过外力打击，抑或是饮用芒硝类液体时，受到了胁迫而大量饮用。
对此说法，李某说，目前尚未发现有这方面的情况和证据。至于外伤，应该是因不良反应而出现狂躁情况后，当事人自身因素造成。
但他也表示，云旭阳之死肯定有被诱导的因素，“包括现在还有一些人蒙在鼓里，认为喝这个对身体确实有好处”。
李某说，案发当时，这个团队出现了“煽动的情况”，“打个比方，一煽动起来，人的情绪一调动起来，哗哗哗，你喝我也喝，是这种情况。也正是这种情况，谁也不会防，因为它是个群体”。

逮捕胡万林，定性为何是非法行医？
云文超认为，胡万林之前曾因非法行医被查处，但此次出狱后，仍不思悔改，号称对外行医或者收徒，包括在云旭阳出现不良反应后，没有寻求正规医院抢救，对该案件的后果，应该存在着较多的放任，乃至主观故意，使得此案有“故意杀人”嫌疑。
同时，张伟也提出，胡万林对人大量使用很有害、危险的物质，明知故犯，导致人的死亡，并且在上世纪90年代被商丘警方查处时，当时的“打假英雄”司马南也曾认为，胡万林的行为可能构成间接致人死亡罪。
“我们没有采纳‘故意杀人’，认定为非法行医，定性合适，是经过深思熟虑的。首先，主观上，他们不是想置谁于死地。” 李某说。
虽然代理律师提出此次胡万林案发与十多年前相比，很多方面完全不同，不应再被界定为非法行医，但李某认为，胡万林的行为实质就是行医，否则只能定为“过失致人死亡”，“你也知道，这个罪名就很轻了”。
现场未透露姓名的新安县公安局刑侦大队大队长表示，目前公安机关包括检察机关的认定，只是初步结论，最终究竟怎样定罪、量刑，还需要法院的进一步审判才能最终确定。
此次“中医研讨”，
到底有无金钱交易？
云文超说，参与此次“中医研讨”活动前，云旭阳曾经向他提过带钱的事，因手头拮据，他最后只给了儿子1000元钱暂用。父子商定，如果还需要花销，云旭阳再和家里联系，他们打款给他。
事后，经过查看聊天记录，云文超才知道，为参加此次活动，云旭阳被要求交纳费用1万元。
按照张伟的说法，组织者明知道涉案芒硝类液体存在极大风险，且早已被有关部门认定为非法行医，举办此次活动还向参与人员收取了数额不等的费用，应该还有诈骗的嫌疑。
李某表示，这一情况，他们在侦查期间已经考虑到了。他说，目前，有证据证明，有人向胡万林支付了费用，胡万林也确实收了一部分人的钱，但还有人说，这些钱是当事人自愿交给胡万林的。
按照李某的说法，这就像一群人听一堂英语课，大家都觉得老师讲得不错，就主动提出来给老师交学费，但老师本人没有提这个要求。

1974年，因反革命罪被判15年有期徒刑。
1980年，胡万林被免于刑事处分，出狱后以贩卖虫草谋生。

1999年，胡万林以涉嫌非法行医罪被商丘警方正式宣布逮捕。
2000年，商丘市中级人民法院一审以非法行医罪判处胡万林有期徒刑15年，剥夺政治权利5年，并处罚金15万元。（大河报）
