对于党政领导干部在企业兼职、任职问题，中国的公务员法、中共于2010年出台的领导干部廉洁从政若干准则，以及中组部、中纪委近年来多次下发的文件中已有相关规定。此次印发的《意见》较以往相关法律法规修改和增加了多个方面的内容。
对照中组部2008年下发的文件可以发现，此前的文件规定，“退出现职、未办理退休手续的党政领导干部原则上不得在企业兼职，一般也不得安排到企业任职”，这对“退出现职、未办理退休手续”的官员留下了制度“缝隙”。
“现实中，一些退出现职但未办理退休手续的党政领导干部在企业兼职或任职，造成了负面的社会影响。”中央党校教授辛鸣表示，此次下发的《意见》已经明确规定，这些干部也不得在企业兼职或任职，堵严了“口子”。
再对照中纪委于2008年下发的文件，不难发现，该文件仅就中管干部辞去公职或者退(离)休后担任上市公司、基金管理公司独立董事、独立监事作了规范，对其他党政领导干部在其他企业兼职(任职)未作规定。
此次下发的《意见》对辞去公职或者退(离)休后的所有党政领导干部到各类企业兼任或担任各种职务的行为统一作了规范，填补了此前的又一项政策空白。
另外，此次下发的《意见》还首次对按规定经批准在企业兼职的党政领导干部在企业兼职的数量、年龄、任期等进行了规定，堵住了此前的制度漏洞，为杜绝一人兼多职、长期兼职、连续兼职等现象提供了保证。
根据《意见》，凡按规定经批准在企业兼职的党政领导干部，“兼职不得超过1个；所兼任职务实行任期制的，任期届满拟连任必须重新审批或备案，连任不超过两届；兼职的任职年龄界限为70周岁”。
在堵住原有制度漏洞的同时，《意见》对领导干部到企业兼职或任职的审批程序进行了更加严格的规定，并且制定了对领导干部在兼职或任职期间进行管理的具体管理办法，要求干部在企业兼职期间的履职情况、是否取酬、职务消费和报销有关工作费用等，应每年年底以书面形式如实报告单位组织。
中共对官员在企业兼职任职问题一直高度重视，并不断采取措施进行治理和规范。2004年，中组部下发《关于对党政领导干部在企业兼职进行清理的通知》后，全国就曾对领导干部在企业兼职进行过一次大规模的清理。
在那次清理工作中，全国按照规定应当进行清理的8400余名县处级以上党政领导干部中，共有8000余名辞去或被免去所兼职务。
“不过，当时清理的主要对象是现职的县处级以上党政领导干部，未涉及不担任现职但未办理退(离)休手续、辞去公职或者退(离)休的党政领导干部，以及县处级以下党政领导干部。”辛鸣说，而且，从2004年至今已经过去将近十年，其间也有一些反弹的情况。
