在当地，动辄数百上千人的拆违执法行动并不罕见。村民们最初和现场的警察对话，希望见到领导。沟通未果后，一批防暴警察持着盾牌围向圣人湾，试图强制驱赶酒店院子里的村民。但第一轮进攻被手持镰刀的村民逼退。
视频记录下了这一幕，村民从圣人湾大门冲出，拿着镰刀挥舞，防暴警察被迫退后。一名老者冲在第一位，挥舞两下后，被后面的一名女子拉了回去。
胡定发也是其中的一员，当时他跟在后面。他向南都记者回忆，面对全副武装的警察，村民挥舞镰刀是为了吓唬一下，“如果真想伤人，把镰刀从盾牌缝隙里伸进去勾两下就行了。”
胡定发称，他们知道无法和警方抗衡。但面对房屋被拆，这些抗拆的村民当时都很生气。在警方即将开始新一轮冲击时，村民们向外面扔燃烧瓶和“水雷”鞭炮。
大门外发出一阵燃烧瓶摔裂的声音，地面上腾起了火苗，门外的特警开始四处躲闪，一些手持灭火器的警员进行灭火。
胡定发也扔了两个燃烧瓶，目的是为了阻止警察靠近。这时双方开始僵持不下。不久，他察觉到形势不对，一群警察持枪出现在酒店右侧一栋房子的楼梯上，在三楼楼梯口的位置，将通向里面一道长廊的铁门破开。
他看到，警察将枪口对准了院子里的村民。
持枪警察所在的位置是梁永达自住房的三楼，胡定发开始往院子后面躲。他手里拿着一个燃烧瓶，听到一个警察冲他喊，把燃烧瓶扔掉。
“我对警察说，你们凭什么拆我们的房子。”他说，这时候子弹向他飞了过来，他头部中弹。
他的大姐胡宝芬目睹了弟弟被击倒的一幕，她当时站在几米远的地方，没想到警察开了枪。枪声开始大作。她以为胡定发死了，情绪失控，就在地上捡起一把镰刀，大喊：“打人了，警察打人了。”她跑出院子，和持着盾牌、警棍围过来的警察对峙。
“我拿镰刀就是壮个胆。”胡宝芬说，看到全副武装的警察感到害怕。她希望警察停止射击，赶快救她弟弟。
子弹也向她飞来。胡宝芬双腿中弹倒地。右腿2颗，左腿1颗，橡皮子弹留在肉里，右腿的子弹撞到骨头，并向下滑去，造成双腿软组织挫裂伤。
现场的视频画面显示，多名警员排成一排开始射击，连续的“嘭嘭嘭”声大作，枪口有明显的火星。在枪声中，隐约能听到“打，打死他”的喊声。
在圣人湾的内部，有人大喊：“子弹，走开啊！”此时，院子中有女声用当地方言大声喊叫。枪声一直没有终止。
距离胡定发几米远的马积荣告诉南都记者，他想去扶起胡定发，刚迈步也遭到了枪击，他穿着布鞋的右脚被橡皮子弹击中，致其骨折。
另一个村民韦美花试图去扶胡定发时，被子弹擦伤大腿内侧。胡定发回忆，这时候，他的脖子、右脸和左臂也被子弹击中了，鲜血横流。
根据村民的介绍，同时中弹的还有胡志昌和马善河，其中一人已被警方逮捕。南都记者获得的几段现场视频中，记录下了警察使用防暴枪发出的“嘭嘭”射击声。仅根据发到网上的其中一段视频统计，从警员上楼到视频结束就传来了19声枪响。
定性“妨害公务案”
被刑拘9人中有抗拆村民也有征地拆迁的举报者
这是当地警方清场所使用的终极手段。在防暴枪的弹压下，村民的反抗很快被消解。院子大门被冲开后，警员在指挥下冲入了院子。站在院子里的村民，有人手中持着棍状物，还有人抱着胳膊，显得并不惊慌。
全副武装的警员很快将一个酒店的员工打倒在地，并开始围殴。梁永达告诉南都记者，被打的是村民林朝龙，他是土地出租者之一林兆和的儿子，在土地租给林永格后，林朝龙在饭店里上班。
视频显示，林朝龙在地面上已经被控制住，没有了还击的能力，警察的殴打并没有终止，不少人上前殴打一阵就退开。一个身穿衬衫，背着写有“adidas”字样斜肩包的男子看到有人被打倒，跑上前去踹了几脚。另一个警察持着警棍，打了林一棍。
清场结束后，拆违执法人员的钩机出动了。据一名村民介绍，仅一上午，这里就被夷为平地。
青秀区政府在官网的信息公开平台介绍此事时措辞甚为严厉，称：“在整治行动的强大铁拳攻势下，数栋违法建筑物迅速被夷为平地……违建者通过违建大发其财的算盘随之破灭。”
根据青秀山公安分局的说法，执法队伍遭遇暴力抗法并致两名执法人员不同程度受伤、消防车等装备不同程度受损，执法人员生命安全受到威胁，“警察被迫使用催泪弹和橡皮子弹，对不法人员进行强制驱散和抓捕。”
此案被立为“9·28妨害公务案”进行侦查。青秀山公安分局的一名副局长透露，目前9名犯罪嫌疑人被刑事拘留，还在对其他犯罪嫌疑人采取网上追逃等措施。
南都记者获得的信息显示，被刑拘的9人中，6人是当地抗拆村民，3人是圣人湾酒店的工作人员。其中包括征地拆迁的举报者黄桂兰。
多年来，黄桂兰和其他的被拆迁户一直积极举报青秀山风景区的征地拆迁问题。青山园艺场和附近的凤岭、三岸等园艺场同属于此前国有的南宁农工商公司的集体土地，每个园艺场相当一个村，后来划拨津头街道办管辖。
在青秀山景区不断扩张、建设“青秀山森林公园”的背景下，周边的园艺场被划入征地的范围，按照当地的规划，园艺场的村民都将面临拆迁和安置。
早在2008年4月，青秀区房屋和征地拆迁办即贴出通知，要求青山园艺场上、下琅村2008年4月30日全部搬离，不然后果自负。时任青秀区委书记肖志钢在征地搬迁动员大会上的讲话上称，整体征地搬迁是青秀山风景区保护、管理、开发的必经之路，实施青山园艺场整体征地搬迁工程势在必行。
根据当地官方公布的拆迁补偿标准，按照人均80平方米的建筑面积签订补偿安置协议，每平方米砖混结构2090元，如积极配合拆迁，80平方米到160平方米的面积，每平方米补250元。而遭到征收的集体土地则按照每个人头23.4万元的标准安置。
因不满当地的拆迁补偿政策，黄桂兰等人拒绝签订拆迁补偿协议。他们要求安置，并办理养老保险。
黄桂兰认为，当地政府的征地拆迁并非严格按照征地程序进行。一些地方存在拆迁人员参与搭钢架棚骗补的情况。并开始进行举报。
拆迁职务犯罪高发
这导致了利益分配不公，加剧了村民的不满
南都记者获得的信息显示，这些举报至少有一部分被证实。青秀区各个园艺场的征地拆迁领域成为职务犯罪的高发区，一些拆迁的关键人物纷纷落马。
据南宁市检察机关接受当地媒体采访时披露，2007年至2008年间，青秀区房屋和征地拆迁办公室原主任姚鹏夔3次收受了一家房屋拆迁公司26.8万元好处费。
2007年7月底，担任津头街道办事处副主任的青平作为青秀区征地拆迁工作队副队长，参与新村四组、青山园艺场整体搬迁工作。
青平没有履行工作职责而直接签字，致使一些红线内“抢种”的违法建筑按合法建筑进行补偿，造成国家275万元补偿款的损失。
2010年1月，三岸园艺场二队原队长滕占如与李毅民、范先军以虚构方式，在2010年至2011年间，共骗取地上附着物补偿款93.4万多元，实际获利71.4万多元。
三岸园艺场五队原队长苏顺强和二队原副队长苏维江也被调查处理。当地村民告诉南都记者，彼时在土地上搭建钢架骗补的事情十分普遍，而拆迁人员对此并非不知情。因拆迁中存在的职务犯罪，导致了利益分配不公，加剧了村民的不满。
拆迁征地步伐加快
市政府发文要求在年内一次性完成剩余集体土地征收
在试图抵抗的村民看来，这次被冠以“拆违”之名的行动，实际是地方政府借机为整体拆迁“铺路”，借以清除障碍。
“签了暂时不拆，不签说是违建。”梁永达称。在这次拆违行动中，梁永达有三套生产配套房遭到拆除。这些房子最早建于1996年。如今也被拆除。梁永达拒绝在征地的安置补偿协议上签字，并曾为此上访。
青山园艺场原来的副场长胡汉生曾负责住房审批，彼时村民子女分家、结婚需要建房，要打报告到场部，由场部进行批准。胡汉生回忆，他当时批了不少，但由于历史原因，场内的房子一直没有办理建设许可。
“上面不给办。”他说，随着征地拆迁大幕的展开，办理建设规划许可更加不可能了。对此官方的说法则是，村民没有申请。
两个月前，当地场部贴出了南宁市政府办公厅最新的文件，要求在2013年内一次性征收完成该场所有剩余集体土地。这意味着当地加快了拆迁征地步伐。
南都记者查询的资料显示，这一文件出台前后，当地近几个月来在征地拆迁的各个园艺场展开了大量的拆违行动。根据当地官方的说法，这是青秀区展开的打击“两违”的专项整治行动。
9月23日，为了配合南宁市重点工程的推进，青秀区班子领导及青秀区城管局、征拆办等职能部门和项目所在街道等单位，出动1350人、7台大型拆除机械，对三岸园艺场苹果园东侧的13栋违章建构(筑)物进行依法拆除。
10月24日，青秀区组织城管、征拆办、津头街道办等部门，对凤岭园艺场及三岸园艺场结合部周边的16栋违法建筑依法拆除，拆除面积达到3.5万平方米……
一系列拆违的举措致使矛盾开始激化。青秀山风景名胜旅游区管委会主任李伟进被任命为青山园艺场统征工作指挥部的指挥长。他否认这次拆违和拆迁有关。
李伟进说，村民违建的住房并没有获得乡村建设规划许可。按照规定一户一宅，而超过每人80平方米的，并在征地工作开展之后搭建，明显是属于违建。按照法律规定，附近类似圣人湾的酒店都将被拆除。村庄整体也将被拆除。
安置房遥遥无期
新一轮征地中，签协议和不签协议的村民分裂成了两派
尽管当地政府强调“整体搬迁”，“妥善安置”，但多年来征地和审批同时进行，加之安置政策的反复，让当地村民并不信任这些承诺。
对住在周转房里的居民而言，安置房遥遥无期加剧了村民的不信任感。胡汉生是场部的老领导，在2008年的拆迁时，他签了拆迁协议，并一直等待政府承诺的安置房。
如今5年过去了，安置房迟迟未见踪影。住在周转房里的村民抱怨简陋的环境。没有签字的村民则时刻担心房子被拆。
胡汉生在2010年开始的这一轮征地时也没有签字。他发现，此前签了拆迁补偿协议后，那栋房子并未被拆除，他随后把房子租了出去。
李伟进称，黄桂兰说政府土地违法并不准确，他认为相关征地拆迁工作都依法进行。签了协议后，没有房子住的仍然可以住在原来的房子里。
但他承认，安置房的建设确实滞缓。此前规划的安置房目前仍在规划之中。最新的办法是，政府重新划了一片400亩的土地，村民可以选择整体回迁。
让胡汉生感到担忧的是，签订协议和不签协议的村民利益渐而出现分裂，成了两派。
在胡汉生看来，征地最早是由一条路开始的。随着沿邕江的青秀路贯通这个此前闭塞的园艺场后，村民告别了历史沿袭下来的平静生活。
青秀山景区开始和周边的园艺场发生矛盾。他们将目光盯紧村民世代居住的土地。
早在2005年开始，青秀山管委会即以建设东南亚美食城项目的名义，在青山园艺场开始大规模征地。
胡定发的养殖场即被征用。在多次谈判之后，他最终妥协了。但他随后发现，这次大张旗鼓建设起来的美食城项目却处境尴尬，与之同一批建起来的一片房子成了“烂尾楼”，埋没在荒草里。
美食城并没有几家饭店入驻，顾客寥寥。南都记者造访美食城时，营业的酒店只有两三家。李伟进不愿意用“烂尾楼”来形容那片建筑，他认为这跟一些建设的问题有关，“不要扯到这上面来。”
彼时，征地的冲突即开始凸显。胡定发对新一轮的征地行为开始抱有疑问。他的回迁房也被认为是违建，这是他拒绝签字的原因。
对于黄桂兰和其他拒绝签字的村民而言，政府安置房的承诺并不是听起来那么可靠。加之认为赔偿不合理，他们拒绝离开土地。
村民认为，政府“加强保护风景名胜区”为名的征地拆迁行动，正在侵蚀他们原来的生活。9月28日这天早上，胡定发和一些抗拆的村民来到了圣人湾酒店。面对以“拆违”为名的上千人执法队伍，他们试图阻止，随后遭到了枪击。
