  人民网北京10月30日电(记者 仝宗莉)国家新闻出版广电总局日前发布《关于进一步加强卫视频道播出电视购物短片广告管理工作的通知》,自2014年1月1日实施。《通知》明确,各卫视频道每天18点至24点时段内,不得播出电视购物短片广告。其他时段播出电视购物短片广告时,必须严格执行总局相关具体规定,如不得使用主持人作宣传;不得使用“叫卖式”夸张配音、语调、动作等作宣传;不得使用“矫形”、“塑形”、“透脂”、“甩脂”等宣传或变相宣传丰胸、减肥产品等。


  据了解,2009年原国家广电总局也曾下发《关于加强电视购物短片广告和居家购物节目管理的通知》,要求上星频道每天18点至24点的时段内不得播出电视购物短片广告,播出机构禁止播出介绍药品、性保健品和丰胸、减肥等产品的电视购物短片广告和居家购物节目。


  本次《通知》指出,近段时间以来,广告违规问题出现反弹,特别是部分卫视频道的电视购物短片广告存在内容夸大虚假、长时间反复播出等问题,造成恶劣影响。对此,各卫视频道要予以高度重视,严格按照《关于加强电视购物短片广告和居家购物节目管理的通知》(广发〔2009〕71号)对两者的界定,认真落实《广播电视广告播出管理办法》(原广电总局第61号令)和71号文件的要求,切实加强对电视购物短片广告的管理工作。


  为此,各卫视频道首先要认真审验在本频道投放电视购物短片广告的企业资质:


  (一)证明其注册资本金不少于1000万元人民币和具有固定经营场所的《企业法人营业执照》、《组织机构代码证》等材料。


  (二)证明其自行建立呼叫系统、物流配送和结算系统,以及健全的售后服务制度和相应机构、人员的材料。


  (三)相关部门出具的证明其经销产品的质量合格检验报告和法律文书。对不具备资质条件或无法出具上述证明材料的企业,一律不得受理和播出其投放的电视购物短片广告。


  另一方面,各单位必须严格规范表现形式,强化播出环节把关。各卫视频道每天18点至24点时段内,不得播出电视购物短片广告。其他时段播出电视购物短片广告时,必须严格执行总局61号令和71号文件的相关具体规定,坚决要做到以下几点:


  (一)不得使用主持人作宣传。


  (二)不得使用“叫卖式”夸张配音、语调、动作等作宣传。


  (三)不得使用新闻报道、新闻采访、现场访谈等形式以及新闻素材、资料等作宣传。


  (四)不得使用“矫形”、“塑形”、“透脂”、“甩脂”等宣传或变相宣传丰胸、减肥产品。


  (五)要在屏幕画面右上角明确标注“广告”字样。


  (六)每天每小时播出电视购物短片广告不得超过1条(次),每条不得超过3分钟,每天播出同一款产品或同一内容的电视购物短片广告不得超过3次。


  国家新闻出版广电总局要求各卫视频道对审核同意在本频道投放的电视购物短片广告,需将《通知》第2条规定的相关资质证明材料以及该购物短片广告的名称、时段、时长、次数和内容等情况,报省级广电行政部门备案。各省级广电行政部门需于每季度结束前,汇总报总局传媒司备案。总局将定期向社会公示,强化社会监督。


  国家新闻出版广电总局要求各省级广电行政部门要严格按照《通知》要求,认真做好辖区内卫视频道电视购物短片广告播出的监管工作,对存在违规问题的,视情节轻重分别给予限期整改、警告、诫勉谈话、通报批评,直至暂停商业广告播出等处理,并追究相关责任人责任,向社会公开曝光。
