各省、自治区、直辖市食品药品监督管理局、卫生厅局(卫生计生委)、工商行政管理局、质量技术监督局，新疆生产建设兵团食品药品监督管理局、卫生局、质量技术监督分局：
为切实保障婴幼儿身体健康，进一步规范母乳代用品宣传和销售行为，按照《中华人民共和国母婴保健法》及其实施办法、《母乳代用品销售管理办法》等规定，现就有关事项通知如下：
一、严格婴儿配方食品质量安全和标签监管
婴儿配方食品是重要的母乳代用品。食品药品监管部门、工商行政管理部门、质量技术监督部门要在认真抓好婴儿配方食品特别是婴儿配方乳粉质量安全的基础上，按照《母乳代用品销售管理办法》和食品安全国家标准规定，加大婴儿配方食品标签标识的日常检查力度，督促婴儿配方食品生产企业依法进行标识标注，督促婴儿配方食品经营单位落实进货查验和查验记录制度。婴儿配方食品标签标识上，应用醒目的文字标注说明母乳喂养优越性的宣传标语，不得印有婴儿图片，不得使用“人乳化”、“母乳化”或类似名词。
二、严禁医疗机构及其人员宣传和销售母乳代用品
卫生计生行政部门要加强对医疗机构及其人员的监督管理，加强医德医风建设，巩固爱婴医院成果，大力推进母乳喂养，维护儿童健康。如有需要，医院应从零售渠道购买母乳代用品，并保留购物小票和发票。严禁医疗机构接受母乳代用品生产经营单位的馈赠和赞助，不得收取回扣、获取利益。严禁母乳代用品生产经营单位在医疗机构做各种形式的推销宣传。严禁医疗机构及其人员向孕妇及其家庭宣传、推销母乳代用品。母乳是婴幼儿的最佳营养来源，母乳喂养是确保婴幼儿健康最为有效方式之一。积极倡导、促进母乳喂养，实行“早接触、早开奶、早吸吮”，为孕产妇及其家庭提供母乳喂养的必要帮助与指导 。
三、规范母乳代用品广告宣传
工商行政管理部门要依法加强对母乳代用品广告的监管检查，加大对发布虚假违法母乳代用品广告特别是虚假违法婴儿配方食品广告的打击力度。严肃查处违反《中华人民共和国广告法》、《食品广告发布暂行规定》等相关规定，含有明示或暗示替代母乳，使用哺乳妇女和婴儿的形象等违法内容的婴儿配方食品广告，切实保障文明诚信的广告市场秩序。
四、加大违法违规行为的惩处力度
监管部门要高度重视，落实监管责任，加大违法违规案件查处力度，做到有举必查、违法必究、执法必严。
(一)食品药品监管部门、工商行政管理部门和质量技术监督部门对日常检查中发现婴儿配方食品生产经营单位和广告宣传单位存在问题的，依法从严处理，并及时通报有关部门。
(二)卫生计生行政部门对违反有关规定的医疗机构及其人员，依据《医疗机构人员违纪违规问题调查处理暂行办法》和《医疗机构从业人员行为规范》等有关规定，从严查处。情节严重的，降低医疗机构评审等次，追究相关责任。
(三)婴儿配方食品生产经营单位应当严格执行《母乳代用品销售管理办法》等法律法规，不得违规推销宣传婴儿配方食品。监管部门发现母乳代用品特别是婴儿配方食品宣传和销售活动中存在商业贿赂的，应移交相关部门依法处置；构成犯罪的，应根据《最高人民法院、最高人民检察院关于办理商业贿赂刑事案件适用法律若干问题的意见》相关条款，移交司法机关依法追究刑事责任。
五、工作要求
(一)监管部门要加强组织领导，明确责任，建立长效监管机制。加大对婴儿配方食品生产经营单位、医疗机构及其人员、广告宣传单位的监督检查力度，严禁出现违法违规宣传和销售母乳代用品。及时总结推广典型做法和经验，形成长效监管机制。
(二)监管部门要密切配合，通力协作，形成工作合力。进一步加强部门间、区域间监管执法联动，强化跨部门、跨地区信息通报和案件协查，严惩母乳代用品的违规宣传和销售行为。
(三)监管部门要畅通投诉举报渠道，向社会公开投诉方式，鼓励社会各界投诉举报母乳代用品违规宣传和销售行为，及时核查处置违法违规行为。
