婴幼儿配方食品
配方标签等应严格备案
2008年三聚氰胺事件以来，很多中国消费者对国产婴幼儿奶粉丧失信心，不少妈妈开始托出国的朋友购买“洋奶粉”。各式各样的“洋奶粉”蜂拥进入中国消费市场。然而，这些洋奶粉质量却参差不齐，反映“洋奶粉”存在分装、造假、质量不过关等问题的呼声愈演愈烈，对中国消费者和乳业也造成一定负面影响。
为强化对婴幼儿配方食品的严格监管，送审稿提出，国家对婴幼儿配方食品实行严格监督管理，食品生产企业生产婴幼儿配方食品应当将生产原料、产品配方及标签等向食品安全监督管理部门备案。不得以委托、贴牌、分装方式生产婴幼儿配方食品。
换言之，国内部分洋品牌，此前因在国内产能不足，需要从海外市场直接进口大包装婴幼儿奶粉，然后在国内再分装，或进口婴幼儿配方乳粉在境内加贴标签等，这些在境内“加工”洋奶粉的方式都将受到严格管控。
网购食品
食品出问题网站先行赔
如今网络购物已经逐渐成为人们日常生活一种重要的交易形式，网络购物的品种也从最初的衣服、电器涵盖到今天的各个领域，淘宝、京东商城、我买网、1号店等多家网络交易平台都在进行食品在线交易。
然而，由于网上销售食品准入门槛低、经营地点不固定、缺乏正规手续，假冒伪劣和“三无食品”混杂其中，网购食品安全问题越来越引起消费者的重视。
在昨日公开征求意见的送审稿中，对食品网络交易监管进行进一步说明，《送审稿》规定了网络食品交易第三方平台提供者应当取得食品生产经营许可，并承担食品安全管理责任；未履行法定义务，侵害消费者合法权益的，应当承担连带责任，并先行赔付。
也就是说，消费者在某一交易平台购买了出现质量问题的食品时，该交易平台将负起相应的连带责任，在对其进行调查核实和处理之前，该交易平台需要出面，对消费者进行先行赔付，以保障网购消费者的合法权益。
责任惩戒
消费者获赔最低千元起
为加大对违法违规行为的惩处，《送审稿》将对违法违规结果的惩戒改为对违法违规行为的惩戒。
在刑事责任方面，完善了行刑衔接机制。在行政责任方面，强化对违法违规食品生产经营者、技术机构的处罚。如在财产处罚方面，将非法添加等严重危害食品安全的行为罚款额度由原法中5至10倍罚款提高到15至30倍，情节严重的，吊销许可证，并由公安机关对直接责任人给予行政拘留；构成犯罪的，依法追究刑事责任。
在民事责任方面，加大经济惩罚力度，规定了最低额赔偿制度。生产不符合食品安全标准的食品或者销售明知是不符合食品安全标准的食品，消费者除要求赔偿损失外，还可向生产者或者销售者要求支付价款10倍或者损失3倍的赔偿金。赔偿的金额不足1000元的，赔偿1000元。
《送审稿》还提出，食品生产经营企业应当按照国家有关规定投保食品安全责任强制保险。具体管理办法由国务院保险监督管理机构会同国务院食品药品监督管理部门制定。
信息发布
对违法行为媒体当监督
《送审稿》中明确，新闻媒体应当开展食品安全法律、法规以及食品安全标准和知识的公益宣传，客观、公正报道食品安全问题，并对违反本法的行为进行舆论监督。任何单位和个人发布可能对社会或者食品产业造成重大影响的食品安全信息，应当事先向食品生产经营企业、行业协会、科研机构、食品安全监督管理部门核实。不得发布未经核实的食品安全信息。
虚假广告
设计及制作也会担责任
《送审稿》中提出，要加大对虚假广告的惩戒力度，并提出明知或者应知食品广告虚假仍设计、制作、发布，使消费者的合法权益受到损害的，广告的设计者、制作者、发布者与食品生产经营者承担连带责任。
与此同时，还将加大虚假检验报告或认证结论的惩戒。明确食品检验机构、认证机构出具虚假检验报告、虚假认证结论，使消费者的合法权益受到损害的，应当承担赔偿责任。
□其他修订
部分监管部门职责调整
根据国务院机构改革方案，部分食品安全监管部门的职责做出了调整。《修订稿》中明确，国务院设立食品安全委员会，其工作职责由国务院规定。同时对国务院食品药品监督管理部门、国务院卫生行政部门、国务院质量监督检验检疫部门、国务院公安部门以及国务院其他与食品安全工作相关的部门应该履行的相应职责作出明确。
县级以上地方人民政府统一负责、领导、组织、协调本行政区域的食品安全监督管理工作，建立健全食品安全全程监督管理的工作机制。
□背景
征求5000余条意见终成型
为使此次修订的送审稿“落到实处”，工作组特别梳理了当前食品安全工作中存在的突出问题，对2009年颁布的《中华人民共和国食品安全法》实施情况进行了评估；同时还研究借鉴国内外有关食品安全工作的实践和经验。为了兼顾公平性与科学性原则，工作组征求各地区、相关部门、行业协会、食品企业以及社会公众意见和建议5000余条，并委托有关单位开展课题研究30多项；召开相关座谈会、研讨会近30次，在此基础上形成了《食品安全法（修订草案送审稿）》，共134条。

即日起有关单位和各界人士可登录中国政府法制信息网（www.chinalaw.gov.cn），以信函和电子邮件spaq＠chinalaw.gov.cn等方式对征求意见稿提出意见。
同时，还可以通过信函方式反映意见，可将意见寄至北京市2067信箱（邮政编码：100035），并在信封上注明“食品安全法修订征求意见”字样。据悉，意见反馈截止日期为2013年11月29日。
