  目前,海南“批而不用”土地总量高达28.68万亩,其中,“批而未征”5.47万亩,“征而未供”10.15万亩,“供而未用”13.06万亩。


  《第一财经日报》昨日从有关渠道获得了一份材料,这份海南省政府《关于全省闲置土地处置工作情况的通报》(下称《通报》)提供了上述数据。而这可能还是一个比较保守的数据。


  在昨日召开的海南省闲置土地处置工作会议上,海南省委副书记、省长蒋定之说,海南许多城市用地指标严重不足,土地成为最大的制约因素和发展瓶颈,同时征而未用、荒芜闲置的现象大量存在,不少土地被晾在一边晒太阳。海南省国土环境资源厅厅长陈健春说,一些市县仍存在漏报、少报、错报、慢报等情况。


  海南土地闲置的问题已经引起了海南省省委书记罗保铭的重视。在今年7月海南省委六届四次会议上,罗保铭对“处置和盘活闲置土地做了重要部署”。


  海南“供而未用”的13.06万亩土地相当于全省两年出让土地的总量。《通报》称,由于闲置土地较多,有关部门和市县在处理这方面的问题时,已经遇到了不小的难度。


  土地问题突出


  本报记者从《通报》上看到,今年10月中旬,针对土地违规问题突出的市县,海南省政府召开了土地违法违规问题警示约谈会,约谈了海口市秀英区等政府主要领导。此前,海南省有关部门对海口、东方和定安的四宗重大土地违法案件挂牌督办。


  《通报》称,“批而未征”的土地,大部分是近五年内批准征收而未征收的。主要原因之一是政府在被征地农民安置区建设方面较慢,在农民没有得到安置之前,被征土地的拆迁工作较慢。


  而“征而未用”的土地,大部分是海南省2007年前在清理处置闲置土地时,通过有偿或无偿方式收回的土地。“供而未用”的土地主要是住宅和商服用地,有6.14万亩,约占48%。从闲置时间看,闲置10年以上的有7.07万亩,占54.14%。


  针对这些问题,海南省近日出台了《海南省闲置土地认定和处置规定》(下称《规定》),自今年11月1日起施行。根据《规定》,非因政府原因和不可抗力造成土地闲置满2年未开发的土地,政府将无偿收回。


  “这不是新政策。”海南现代管理研究院院长王毅武在接受本报记者采访时说,多年来,海南省有关部门一直强调处置被闲置土地,如果有关政策能够真正得以执行,海南今天就不会有这么多的土地被闲置。


  “这一次能不能执行下去?会不会像往常那样放空炮?”王毅武说,当闲置的土地累积到一定程度时,政府再去处理就会变得更加棘手。


  就像王毅武所说的,《通报》说,“闲置土地数量多,情况复杂,处置难度大……处置工作量很大”。


  《通报》称,因政府原因造成闲置的土地较多,而市县政府财政资金有限及储备土地不足,采取置换或有偿收回方式处置的压力较大。而企业原因造成闲置的宗地处置程序较多,处置时间较长。还有一些闲置宗地已经转让、抵押,或者已经被法院查封。


  八个月解决闲置问题?


  一位业内人士对本报记者说,房地产开发商与政府有着千丝万缕的关系,在“法不责众”的心态下,这些房地产开发商就“能闲置就尽量闲置”。


  近年来,伴随着房地产市场的高飞猛进,企业“囤地现象”在全国各省屡有发生。尽管中国房地产市场已经发展多年,但绝大部分开发商的盈利模式依旧是依赖土地的升值。而在各级城市,尤以二线以下的城市为甚,捂地现象较为普遍和严重。


  闲置土地是指土地使用者依法取得土地使用权后,未经原批准用地的人民政府同意,超过规定的期限未动工开发建设的建设用地。2011年12月,国土资源部公布《闲置土地处置办法(修订草案)》,土地闲置2年可无偿收回。


  2012年6月,国土部正式发布经修订通过的《闲置土地处置办法》,规定闲置土地两年未动工将由政府收回使用权。该办法自当年7月1日起施行。


  近年来,海南省引进的大项目纷纷落地,土地供应矛盾正在凸显。但由于种种原因,海南大量的闲置土地一直未曾得到开发。


  海南省国土环境资源厅有关负责人在解读《规定》时说,新《规定》进一步明确:需挖深基坑的项目,基坑开挖完毕的,视为动工;使用桩基的项目,打入所有基础桩的,视为动工;其他项目,地基施工完成三分之一的,视为动工。


  蒋定之则在昨日召开的海南省闲置土地处置工作会议上强调,今后规划建设项目,必须优先考虑开发利用闲置土地,对闲置土地多的市县,要考虑减少甚至暂停用地指标供应,以督促限期消化处理。而对那些土地储备过量、开发能力严重不足、以囤地为目的的企业,要清理出海南土地市场。


  “十二五”期间,海南全省实际新增建设用地将达44万亩,根据土地利用总体规划,今后海南可用的全部建设用地指标总共才65万亩。蒋定之称,越往后,海南的土地指标缺口将越大,土地约束将越突出,因此要十分重视存量挖潜。


  而按照海南省政府专项工作方案要求,闲置土地处置工作应在2014年7月1日前处置整改到位,目前还有八个月的时间。
