Bribery crimes jailed in North’s richest man has bought 200，000 deputies titles

　　"Guangdong's richest" jailed 16 are dismissed

　　Hit 16 million bribe 31 officials had spent 200,000 dollars for NPC titles

Two years ago, the "richest man in Northern Guangdong," Zhu Si Yi suspected bribery case, a sensation. 　　“粤北首富”获刑16年 申诉被驳回

　　曾砸1600万行贿31名官员，花20万买全国人大代表头衔

　　两年前，“粤北首富”朱思宜涉嫌行贿案轰动一时。该案件在一、二审法院审理时，揭出他为了掩盖其罪行及获得全国人大头衔，分别向原韶关市委常委、政法委书记、市公安局局长叶树养及广东省人大常委会选举联络人事任免工作委员会原副主任杨成勇行贿共计220万元。但他本人认为这两项犯罪事实不准确，向广东省高级人民法院提出申诉。近日，广东省高院作出驳回其申诉决定，维持判决朱思宜以行贿罪数罪并罚，执行有期徒刑16年的决定。

　　担心行贿暴露送公安局长200万

　　朱思宜是韶关宜达燃料开发有限公司董事长。经法院查明，多年来，为打开所办企业的煤炭销路，朱思宜不惜重金，先后向31名韶钢集团负责人和地方官员行贿，累计行贿逾1600万元人民币。为掩盖其罪行，其向原韶关市委常委、政法委书记、市公安局局长叶树养行贿200万元人民币。

　　2011年9月25日，河源市中级人民法院对朱思宜及宜达公司行贿一案作出一审宣判。朱思宜不服上诉，此案于2011年11月25日在广东河源市中级人民法院二审再次开庭审理。广东高院最终驳回朱思宜上诉，维持原判，以行贿罪数罪并罚，决定执行有期徒刑16年。

　　由于不服判决，朱思宜提出申诉，他认为原审将他代表单位向叶树养实施的单位行贿200万元认定为个人行贿是错误的，应属于单位犯罪。但省高院审查认为，宜达公司是朱思宜一人出资，实施该行为是基于行贿事宜暴露，担心自己会被抓而向叶树养行贿200万元，行贿的目的不是为了公司的经营活动，而是为了自己免于被追究刑事责任。

　　花20万买头衔辩称是联络感情

　　一审、二审法院查明，2007年5月至2008年，朱思宜为顺利当选全国人大代表，共送给原省人大常委会机关副巡视员、选举联络人事任免工作委员会副主任杨成勇20万元，杨成勇为他提供了便利和帮助。

　　但朱思宜认为，他送给杨成勇20万元是为了联络感情，没有谋取不正当利益，不构成行贿罪的问题。经省高院查明，从一开始朱思宜主动结识杨成勇并向杨成勇送钱，是看中杨成勇的广东省人大常委会选举联络人事任免工作委员会副主任的身份，是希望杨成勇利用其职务之便为其当选人大代表提供帮助，这种财物的给与是建立在权钱交易的基础上。事实上，杨成勇收受其贿赂款后，为朱思宜提供了选举信息，为其顺利当选为全国人大代表提供了便利条件。
