每日甘肃网-兰州晨报讯(记者赵野 通讯员刘刚) 因犯受贿罪被皋兰县法院判处有期徒刑5年，兰州市城市运输管理处稽查大队原大队长朱连成提出上诉。11月11日，兰州中院终审以受贿罪改判其有期徒刑3年6个月，一审法院未予认定的自首情节，二审予以认定。
现年51岁的朱连成原系兰州市城市运输管理处稽查大队大队长，2012年6月27日被皋兰县检察院刑拘，同年7月3日被逮捕。一审法院审理查明，2007年12月底，朱连成因个人私事急需用钱，便向兰州市某报废汽车回收中心经理倪某索要人民币1万元。2012年3月，甘肃省康乐县某银行工作人员马某为了让朱连成帮忙调整其运营的大巴车线路，向朱连成行贿1万元。而早在2003年至2008年期间，温州人黄某为了让朱连成照顾自己兰州至温州路线的客运车生意，每年以拜年名义，向朱连成行贿共计1.8万元。此外，当某些公司运营大巴因无照运营被查扣后，便有中间人找朱连成帮忙解决，朱连成利用职务之便，总能将车辆顺利放行，事成之后，朱连成为此得到了不少感谢费。
一审被皋兰县法院判处有期徒刑5年后，朱连成以收取的欠款部分属过年时的馈赠，其中有5000元用于给大队工作人员搞福利办卡发放、不应计入受贿数额，有自首情节原判量刑过重等为由提出上诉。该案二审时，朱连成及其辩护人亦在庭审时重申该观点。
二审法院审理认为，原审认定朱连成犯受贿罪的事实清楚，证据确实充分，定罪准确，唯对朱连成是否存在以自首论的情节未能查明并予以认定不当。根据朱连成受贿5.1万元的数额，其中有索贿1万元应从重处罚的情节，结合其到案后能主动如实供述司法机关尚未掌握的具体受贿犯罪事实，应当以自首论的情节，以及案发后退缴了全部赃款等情节，综合考虑依法对其减轻处罚，原判量刑偏重，应予改判。据此，法院作出前述判决。
