深圳市政协原副主席、汕头市原市委书记黄志光昨日在广州中院受审

100万元现金、17斤冬虫草、26件玉器、7把枪、1套别墅……这些耀眼的东西，如今成为了黄志光获罪的关键。
昨日，深圳市政协原副主席、汕头市原市委书记黄志光在广州市中级人民法院受审，公诉机关指控其涉嫌受贿折合人民币约550余万，并犯非法持有枪支罪。
黄志光现年59岁，广东海丰人。17岁开始参加工作，在企业从一名普通工人干到领导职位。工作20年后，黄志光转入政坛，担任深圳市运输局副局长。此后官运一路亨通，直至深圳宝安区委书记。
2003年，黄志光调任汕头，尔后当上汕头市长、市委书记，成为地级市一把手。2010年，黄志光调任深圳市政协副主席、党组副书记。
颇让人玩味的是，黄志光出事前曾多次在公开场合向下属强调要严守党纪、管好配偶和子女，要“清清白白做官，干干净净做事。”没想到，任深圳市政协副主席仅一年，他便被宣布涉嫌严重违纪违法。
在昨天的庭审中，黄志光对大部分指控表示认罪，但对部分事实仍有异议。
庭审到最后，公诉人提出，黄志光作为一名国家工作人员，未能把握底线，收钱为他人跑官升迁，陷入诸如玉器等私好里，应当接受法律制裁。黄志光则提出，自己一身病症，希望法庭可以轻判。
据了解，黄志光案发后已退赃80万元，此案有待进一步审理。
【庭审直击】
三大焦点控辩双方各有说法
昨日，步入广州中院的黄志光，头发稀疏泛白，脸上长出了老年斑，与出事前出现在镜头里的形象相比判若两人。
听完指控，黄志光对刘某某、郑某某共70多万元贿款，坦承“收了”。对其他指控，则基本进行了“情况说明”。比如，对于非法持有枪支一事，黄志光说，5支从未上证的枪支，是深圳市某领导给他试用的，因调任汕头走得急，没来得及还。之后一拖，便把这事也给忘了。

义兄给120万元，是受贿还是借款？
公诉人认为两人前后说法不一致不足采信，而且黄志光一家根本不差这钱
最有争议的是，黄志光翻供称黄顺丰的120万元，是借款。
日前，其义兄黄顺丰庭审翻供称其与黄志光只是普通朋友，120万元仅仅是垫款。昨日，黄志光申明其与黄顺丰是拜把兄弟，一年见面起码七八次；但也否认120万是贿赂。
此前黄志光供述，给儿子买婚房时，看中了一套990万元的别墅。黄志光的亲戚帮忙张罗此事，黄顺丰多有介入并提出出资100万，最后干脆连零头也出了。昨日，黄志光称其早前说明了，因为买房时他在汕头工作，不方便凑钱转账。为了避税，双方签约合同售价是两三百万，业主要求一次性付款。看房价涨得快，他就借用黄顺丰120万元买下房，差不多一个月就还了110万元。辩护律师提出，黄顺丰与黄志光在后期供述，都否定了行贿120万元且两人没有串供。
对此，公诉人认同没有串供，但认为两人一开始认账，为趋利避害又翻供；二人在还钱时间、数额等问题上一直有严重细节出入，前后说法不一致，不足采信。公诉人说，从黄志光一家的账户看，根本不差这钱。
当公诉人问及黄志光如何迅速筹集100万元时，黄志光解释其母早年救过一人，此人之后到香港发展，便常年资助黄家。几十年来，因工作忙和此人未曾谋面。其母亲过世前瞒着姐妹给了他300多万元。而且，他还有一位当官的义父，过世前也给他留下100多万元。
收钱后捐给寺庙，算不算是受贿？

对于收受深圳某实业集团老总李某鹤100万元，黄志光供述了细节。他说，李某鹤曾两次送钱给他，他都拒绝了。
之后，他在某寺庙为母亲超度时，该住持说寺庙资金紧张，希望黄能帮忙拉捐款。黄志光就找来李某鹤。李某鹤当即表示愿意捐200万元，100万元则以黄志光的名义捐。
一日，李某鹤和黄志光之子吃饭，其儿子带回了一箱“土特产”。到了捐款日，李某鹤来电，告诉他务必带上那箱“土特产”。这下，他才明白过来，“土特产”里头装着钱。之后，他把这笔钱以儿子的名义给捐了。其辩护律师认为，这笔钱没进黄志光腰包，黄不过挂个虚名，不能算贿赂。
公诉机关则称，黄志光收受100万元，具有明显的主观故意；黄志光捐钱求佛祖保护，在佛石上刻下名字，供香客跪拜敬仰，也是在图名谋利，属于受贿情形。
冬虫草一斤3万多元，鉴定价偏高？
公诉人指出，行贿人吴某某已证实这批冬虫草的级别，鉴定价已经算低
对于收受玉器摆件、罗汉床、冬虫草等，黄志光和辩护律师对鉴定价值提出异议。
黄志光说，有些玉器有裂痕、有瑕疵，估算169.45万元，偏高。其辩护律师说，冬虫草也分类型等级，而且有些冬虫草一盒不足一斤，有些只有八两，可能填充了其他物品，一斤3万多元的鉴定价，偏高。
公诉人解释，从黄家搜出来的玉器摆件，要黄志光一件件回忆出处或价值，确实有难度。但行贿人詹某某是玉器爱好者，对送出东西有印象，证言可信。物件价格没有书证和明确的说法，从有利于被告人的角度，对其中一件玉器及罗汉床的价格，同意采用证人说法。如果还有异议，尊重重新鉴定的决定，但现在估价并不高。
关于冬虫草，公诉人指出，已查实相关涉事人员串供作伪证。下属求升职，贿送物上缺斤短两，不符合常理。行贿人吴某某已证实这批冬虫草的级别，鉴定价已经算低了。
■检方指控
帮五人升官谋利过百万
据起诉资料，黄志光的受贿始于1999年。从担任深圳市宝安区委书记到汕头市一把手，至少帮过五位官员升迁，从中谋利不下百万元。
1999年2002年，黄志光在任深圳宝安区委书记，多次收受宝安区农业局局长、深圳市宝安区光明街道办事处主任、党委书记刘某某的贿赂共计人民币35万元；收受宝安区教育局副局长郑某某贿赂人民币40万元、港币2万元，帮助二人升迁职位。
2005年至2006年，黄志光在任汕头市长、市委书记，应其义兄黄顺丰的请托，帮曾某，徐某升迁。后来，二人均官至局长。
2008年至2010年，黄志光收受汕头市委副秘书长吴某某给予冬虫草17斤，价值人民币58.22万元。之后，曾到边远地区挂职的吴某某，顺利转正处。
儿子买别墅收义兄120万
检方指控，2002年至2010年，黄志光帮拜把兄弟黄顺丰拿到宝安区光明街道工程；应黄顺丰请托，帮人升迁；还帮黄顺丰持股的公司开展业务。
其间，黄顺丰为感谢义弟长期关照，在黄志光为儿子买别墅时，送来人民币120万元。
收100万元现金捐给寺庙
检方指控，2008年9月，黄志光收受深圳市某实业集团董事长李某 鹤(另案处理)给的100万元现金，并用其儿子的名义捐给海丰莲花山某寺庙。随后，在汕头市东部城市经济带某招标项目中，李某鹤一举中标。
另一名企业家则用“喜好”攻破了黄志光。检方指控，从2002年至2010年，深圳某集团董事长詹某某贿送给黄志光各种物件，包括价值约169万元的玉石摆件共26件、市价近30万元的香枝木罗汉床。
尔后，黄志光为詹某某亲戚的职务调动、詹某某在南澳的投资、詹某某投资在汕头设立记者站等事提供不少帮助。
另外，2011年，黄志光家中被搜出制式猎枪6支、制式气枪一支。检方指控黄志光行为构成行贿罪、非法持有枪支罪。
