澳媒 涉案者被限制出境正试图保释回国
《时代报》报道称，43岁的宋劲松(音)是中国的一家政府所属的城市规划机构的负责人，今年8月，他在新南威尔士州被捕并被引渡至维多利亚州的墨尔本，他被控的罪名包括两项指奸。被引渡至墨尔本后，他每天都要向当地警方报到。
宋劲松在接受了包括上交护照、不得离开澳大利亚等条件后获得保释。当地时间上周四，他在墨尔本治安法庭出庭聆讯，申请变更保释条件，以便自己可以回到中国。他提出的条件包括每天向广州当地警方报到，每月返回维多利亚州一次。

据查，广东省城乡规划设计研究院确有一名名为宋劲松的副院长，与澳大利亚媒体报道中提到的代表姓名同音。去年10月21日，宋劲松曾以广东省政协委员的身份出席北大深圳研究生院城市规划与设计学院主办的学术论坛，并被聘为客座教授。今年1月通过的十一届广东省政协委员名单中，宋劲松位列科学技术界的71位委员之中。
在广东省城乡规划设计研究院的官网上，宋劲松最后一次出现在报道中是今年8月2日，他在深圳出席了一个学术沙龙。
《时代报》报道刊发后，大量网友猜测报道中的涉案者就是广东省城乡规划设计研究院副院长。斯蒂夫·布彻看到公开报道中的宋劲松照片后认为很像法庭上出现的涉案男子，但“不能100%确定”。
南都记者与他的多名同事联系求证此事，都未获正面回应。上周五晚南都记者曾拨通宋劲松本人的电话，但说明采访意图后就被挂断，此后就再也无法与其取得联系。
昨日下午，广东省城乡规划设计研究院行政部的一名负责人在接受南都记者采访时称，涉案者确系该院副院长宋劲松。《时代报》提及宋劲松时称他是一名“代表团成员”，但负责人证实，宋于今年8月持因私出国护照赴澳大利亚，行程并不是由院方安排的。此后院方并未与他取得联系，院方也是在看到外媒相关报道后才发现此事。
该负责人称，目前院方正在等待相关法律程序的处理结果。
昨日，中国驻墨尔本领事馆的一名官员向南都记者表示，有一名我国外交官正在处理相关事宜。
指控罪名
在墨尔本被指控罪名：指奸
南都记者从《时代报》记者处了解到，宋劲松在墨尔本被指控的罪名为“指奸”，即以手指侵犯被害人下体。澳大利亚维多利亚州的法律规定，强奸(包括指奸)最高刑罚为终身监禁。
而根据中华人民共和国刑法，这一行为不构成强奸罪，所涉罪名为“强制猥亵妇女罪”。我国刑法第237条规定，以暴力、胁迫或者其他方法强制猥亵妇女或者侮辱妇女的，处五年以下有期徒刑或者拘役。
分析
若弃保，可能被引渡
2008年全国人大常委会通过了《中华人民共和国和澳大利亚引渡条约》规定，根据提出请求时缔约双方的现行法律可判处一年或者一年以上监禁或者更重刑罚的任何罪名的犯罪，均属于可引渡的犯罪。若宋劲松放弃保证金回国后滞留中国，不回澳大利亚受审，澳大利亚司法部门可能向中国提出引渡请求。
该条约同时规定，双方均有权拒绝引渡本国国民。若澳大利亚司法部请求中国外交部引渡宋劲松，而中国以国籍为由拒绝引渡，则中国应当将该案件提交本国主管机关以便根据中国国内法提起刑事诉讼。此时，澳大利亚应当向中国提供与该案件有关的文件和证据。
回国后仍可被追究刑事责任
根据刑法第7条规定，中华人民共和国国家工作人员和军人在中华人民共和国领域外犯中国刑法规定之罪的，适用刑法。同时刑法第10条规定，凡在中华人民共和国领域外犯罪，依照本法应当负刑事责任的，虽然经过外国审判，仍然可以依照本法追究，但是在外国已经受过刑法处罚的，可以免除或者减轻处罚。
因此，中国法院对宋劲松在国外的行为具有刑事管辖权。若宋劲松弃保或被墨尔本法院判处罪名成立，中国法院仍然可以强制猥亵妇女罪追究其刑事责任。
