　　据公开资料显示，去年10月21日，宋劲松曾以广东省政协委员的身份出席北大深圳研究生院城市规划与设计学院主办的学术论坛，并被聘为客座教授。今年1月通过的十一届广东省政协委员名单中，宋劲松位列科学技术界的71位委员之中。

　　不少网友表示，作为一名政府官员，“真可谓丢人丢到国外去了”，而其因私出国竟然长达3个月，明显超过国外逗留期限，主管部门竟称不知情，令人不可思议。

　　国外受审或面临终身监禁 引渡回国亦难逃党纪国法严惩

　　记者采访了解到，宋劲松在墨尔本被指控的罪名为“指奸”。澳大利亚维多利亚州的法律规定，强奸(包括指奸)最高刑罚为终身监禁。

　　但法律人士却认为，根据我国刑法，这一行为不构成强奸罪，所涉罪名为“强制猥亵妇女罪”。我国刑法第237条规定，以暴力、胁迫或者其他方法强制猥亵妇女或者侮辱妇女的，处五年以下有期徒刑或者拘役。

　　法律人士表示，根据2008年全国人大常委会通过的《中华人民共和国和澳大利亚引渡条约》，若宋劲松放弃保证金回国后滞留中国，不回澳大利亚受审，澳大利亚司法部门可能向中国提出引渡请求。

　　“根据条约规定，双方均有权拒绝引渡本国国民。若澳大利亚司法部请求中国外交部引渡宋劲松，而中国以国籍为由拒绝引渡，则中国应当将该案件提交本国主管机关以便根据中国国内法提起刑事诉讼。而澳大利亚应当向中国提供与该案件有关的文件和证据。”北京市盈科(广州)律师事务所律师周玉忠表示。

　　实际上，根据我国刑法第7条规定，中华人民共和国国家工作人员和军人在中华人民共和国领域外犯中国刑法规定之罪的，适用刑法。我国刑法第10条规定，凡在中华人民共和国领域外犯罪，依照本法应当负刑事责任的，虽然经过外国审判，仍然可以依照本法追究。

　　“若宋劲松弃保或被墨尔本法院判处罪名成立，中国法院仍然可以强制猥亵妇女罪追究其刑事责任。”周玉忠表示，毕竟两国法律量刑不同，宋若被引渡回国，争取减轻处罚也是“权宜之计”。

　　有专家表示，此事经媒体发酵后已关系中国司法形象和中国外交事宜，宋即使被引渡回国，依然会遭到党纪国法的严惩。
