　　国外受审或面临终身监禁

　　但法律人士却认为，根据我国刑法，这一行为却不构成强奸罪，所涉罪名为“强制猥亵妇女罪”。我国刑法第237条规定，以暴力、胁迫或者其他方法强制猥亵妇女或者侮辱妇女的，处五年以下有期徒刑或者拘役。

　　法律人士表示，根据2008年全国人大常委会通过的《中华人民共和国和澳大利亚引渡条约》的相关规定，若宋劲松放弃保释金回国后滞留中国，不回澳大利亚受审，澳大利亚司法部门可能向中国提出引渡请求。

　　引渡回国仍可以追究刑责

　　“根据条约规定，双方均有权拒绝引渡本国国民。若澳大利亚司法部请求中国外交部引渡宋劲松，而中国以国籍为由拒绝引渡，则中国应当将该案件提交本国主管机关以便根据中国国内法提起刑事诉讼。而澳大利亚应当向中国提供与该案件有关的文件和证据。”北京市盈科(广州)律师事务所律师周玉忠表示。
