　　“根据条约规定，双方均有权拒绝引渡本国国民。若中国以国籍为由拒绝引渡，则中国应当将该案件提交本国主管机关以便根据中国国内法提起刑事诉讼。而澳大利亚应当向中国提供与该案件有关的文件和证据。” 北京市盈科(广州)律师事务所律师周玉忠表示。

　　我国刑法规定，中华人民共和国国家工作人员在中华人民共和国领域外犯中国刑法规定之罪的，适用本法。

　　“若宋劲松弃保或被墨尔本法院判处罪名成立，中国法院仍然可以强制猥亵妇女罪追究其刑事责任。”周玉忠表示，毕竟两国法律量刑不同，宋若被引渡回国，争取减轻处罚也是“权宜之计”。
