　　公园噪音是否太大？服务项目收费是否太贵？无障碍设施是否完善？昨日，广州市人大代表法制专业小组暗访了流花湖公园和越秀公园，并随机请若干位游园市民填写了调查问卷。调查发现，大多数市民认为公园内市民自发组织的跳舞、唱歌，对周边居民造成了“严重影响”，餐饮、游乐设施项目设置不合理，服务项目收费太贵，厕所太少。

　　据了解，广州市林业和园林局负责牵头起草的《广州市公园条例》目前已完成立法公众参与和专家论证，拟于近期报市政府常务会议审议通过后报送市人大。“接下来市人大还将组织大规模的调研，并在网上充分征求市民意见，《条例》预计于明年年底前正式出台。”市人大法工委主任陈小清说。

　　《条例》拟规定，将首次在公园内设立功能分区，市民在安静休憩区内禁止开展喧闹的健身、娱乐等活动，违者最高将被处以1000元的罚款。

　　具体来说，临近学校、医院、居民区、办公场所等需要安静氛围场所的公园场地，将划为安静休憩区，不得进行喧闹的健身、娱乐等活动，违者由园林行政主管部门责令改正，拒不改正的，处以200元以上、1000元以下罚款；而在划定的健身、娱乐活动区域内，公园管理机构将会根据公园的具体情况制定音量标准和限定的活动时间，有条件的公园则设置音量监控设备。

　　而为了保持纪念性公园庄严肃穆的气氛，草案也明确禁止在此类公园的主要纪念区域开展健身、娱乐活动，违者将处以500元以上2000元以下罚款。

　　公园高档酒楼该拆的要拆

　　为防止公园沦为“吃喝公园”，还绿于民，《条例》拟规定公园内配套商业服务设施的建设标准和要求，明确禁止政府投资建设和管理的公园建设会所、酒吧、高档餐馆、夜总会、酒店、宾馆等不符合公园功能或者有碍公园景观的设施，禁止将亭、台、楼、阁等园林建筑改建为营利性服务设施，并要求不符合规定的设施应当限期拆除或者整改。

　　他表示，因为公园里面并非所有餐饮服务业都不能有，为了服务游客，经过规划和批准，可以继续合法建设和经营，但是不必要的、过分高档的酒楼、餐厅、酒吧，如果不符合规划，不符合法律规定，则条例会做出禁止性规定和处理办法。“至于为何现在还有一些高档酒楼，那是多年以来逐步累积的一些问题，只能等到立法后，逐步解决，如果不符合法律规定，该拆的就要拆，该停的就要停。”

　　宠物能否入园条例将有规定

　　关于公众关注的宠物入园问题，《条例》拟规定，风景名胜公园、历史名园、纪念性公园和动物园禁止携带宠物进入，不过盲人、肢体重残人士可以携带导盲犬、扶助犬入园。

　　至于其他公园，管理机构可以自行决定禁止携带宠物入园，并在公园入口的显着位置设置宠物禁入的标志。

　　记者昨天暗访两个公园，整个上午未见到一只宠物狗。

　　陈小清介绍说，前年广州制定绿化条例曾规定宠物狗可以进公园，但要在固定区域，并且设狗厕所。在制定《条例》时，将进一步考虑，看是否要对此前的规定进行调整，将对能否携带宠物进园作出明确规定。
