　　对此，一审法院审理后认定，李学智以给检查组成员购买化妆品为由，收取当地环保部门款项，并汇入其指定账户，且检查组成员实际并未收到用该笔款项购买的化妆品，据此可以认定李学智利用职务便利，非法收受他人财物的事实。

　　指控2：以停业整顿为由 收受190万现金

　　检方指控称，2011年1月13日，李学智到河南省新乡市新亚纸业集团股份有限公司检查。在检查过程中，他以新亚纸业存在污水直接渗入草地等多种理由要求对方停业整顿，并先后从该公司董事长宋某处收受现金190万元及价值3.4万余元的手机5部。宋某也在证词中称，他曾在李学智的要求下，为其送去40万元现金和5部手机，但李学智却提出再要300万元。“他说这钱是领导要的。”宋某称，他只好又送了150万元过去，“这次我并未看到所谓的领导，只见到身材瘦小的刘某”。

　　面对检方的指控及宋某的证词，李学智辩称，宋某曾委托自己为其办理北京户口，并拿出40万元。“这次见面，我本是要把这40万退给他，谁知他又带来150万元。”李学智称，因对方不停央求自己收下钱款，出于无奈，他才作为担保将钱借给刘某。

　　对于控方此项指控，一审法院经审理认为，因在案证据无法确定款项性质，故该笔指控事实不清、证据不足，不予认定。这也是此次检方提出抗诉的主要理由。

　　控诉机关还称，2009年4月间，李学智在担任环境保护部华北环境保护督查中心办公室主任兼人事处处长，他借负责对调任人选进行考查的职务便利，在对河北省秦皇岛市环保局干部刘某考查调动工作过程中，从刘某处收受现金18.6万元。控方还称，李学智还利用其环境督查检查的职务便利，于2011年1月间，在河南省鹤壁市淇县污水处理厂进行污染物总量减排核查过程中，先后向当地环保部门索要人民币共计2万元及价值人民币1.2万元的茶具、纪念币等物品。

　　昨天庭审中，面对检方的指控及证人的证词，李学智均表示不认可，“我并没有索贿，企业给的钱也没有揣进我的腰包”。此案当庭未宣判。
