樊鹏飞告诉记者，这些母猪是“6•14拆违”事件的幸存者，当时厂子被断水断电，饲料生产和搅拌车间也被捣毁，炎炎夏日，陆续有近千头猪中暑死亡。
樊鹏飞是广西河池人。6年前，经过政府招商部门介绍，他来到柳江县投资办金属瓦厂，后更名为柳州市三升金属结构有限公司(以下简称三升公司)。当时他接触的是濒临倒闭的柳州市水产饲料厂，与该企业签订了名承包实租赁的合同后，樊鹏飞开始一展身手。
短短两年，樊鹏飞便把金属结构公司办得有声有色，规模不断扩大，利税年年增长，2009年被柳州市授予“强优企业”称号，并获得1.2万元奖金。然而，彼时柳江国土管理部门却提出养殖用地搞工业属违法占地，樊鹏飞于是在厂区内建猪舍，养起土猪。
“怎么都躲不过，没想到他们真的来拆了。”樊鹏飞说，2013年6月14日，在没有强制执行决定书、没有听证会、没有公告的情况下，柳江县城建监察大队会同公安等部门，出动大型机械，对钢构厂和养殖场进行强拆，“除了两座有活猪的猪舍外，几乎能拆的都拆了，包括原水产饲料厂的办公楼和围墙，物品没外搬，全砸埋到废墟里了，直接和间接损失达几千万元”。
樊鹏飞认为，这不是在拆违法建筑，而是直接扼杀他的企业，其根本原因，一是重点项目建在旁边，这块无人问津的土地变为热土，有人想赶他走；二是外地人好欺负，在上级“拆违”任务高压下，拆你没商量。
昔日“强优企业”
“我在柳州市做钢构生意快20年了，随着业务的扩大，这片店越来越不够用了，便到附近的柳江县去找合适的发展场地。”在柳州市一处门店的二楼，樊鹏飞向记者讲述了到柳江办厂的经过。
2006年8月，经柳江县招商局牵线搭桥，樊鹏飞与柳州市水产饲料厂结下缘分。
柳州市水产饲料厂始建于1988年，隶属于柳州市园林局，以养殖和生产饲料为主，所用场地为划拨土地，在柳江县塘头村地界内。
据厂长陆美发回忆，饲料厂最先养鱼，但随着地下水位发生变化，水源补给不足，池塘淤泥越来越厚，无法养鱼了，后来还养过牛、猪和鸡等畜禽，均未能改变企业窘迫的现状，至2006年，饲料厂已经资不抵债，员工全部下岗，面临倒闭，当时最迫切需要解决的是企业生存和职工生活问题，柳州市主管部门制定了改制方案，把场地、厂房等设施承包给职工或外来人员经营。
“当时谈了不少家，有的条件苛刻，有的想空手套白狼，都没有成功，最后遇到了樊鹏飞，不但给的承包费最高，还预付了70万元用于改制费用，使职工得到安置，解决了企业的燃眉之急。”
记者看到，《承包合同》中载明承包范围为养殖用地99100.5平方米(约148亩)、工业用地4010.35平方米(约6亩)及地面上所有附属设施，承包费每年每亩1000元，期限为20年。2010年12月，双方签订补充协议，由于水产饲料厂与塘头村存在土地纠纷，致使三升公司长期不能正常经营，饲料厂最后同意划出部分地块平息事态，并将承包期限延长至2032年。
这样一来，承包土地只有院墙内的90亩了，从合同上看是承包经营，似乎钢构厂改变了原企业的性质，但陆美发强调说，谁都清楚水产饲料厂已经走到尽头，唯土地还有利用价值，名义上是承包经营，实际为场地租赁。
樊鹏飞告诉记者，建厂之初，柳江县政府有关部门都很支持，建设局分三次批准了1万多平方米的钢架结构临时厂房建设，2008年4月，县发改局给三升公司办理了投资项目登记备案证。备案证显示，该厂年产6000吨钢结构产品，项目总投资3000万元，项目占地面积50亩，厂房、车间等设施总建筑面积2万平方米。
2009年4月，因项目进度及对当地的经济贡献，三升公司被评为柳州市强优企业，“当时柳江县政府召开大会，有20多家企业获此荣誉，我们身披绶带，胸带红花”。樊鹏飞至今回忆起来还神采飞扬，但他话锋一转，“可惜那些获奖证书被强拆者全埋到废墟中了”。
今日“违建大户”
企业是一步步发展起来的，当三升公司申请建设第4批临建厂房时，却被拒绝了，理由是“养殖用地不能搞工业”。樊鹏飞对记者说：“好呀，不让扩大工业，养猪我也是内行。”他在水产饲料厂原牛栏鸡舍的基础上，改建了1万多平方米的钢管金属瓦结构猪舍，并硬化了路面，“现代养猪场，总不能在烂泥巴里踩呀！”
其实，樊鹏飞在河池老家就从事过养猪，他摸索出一套养土猪的办法：“猪是吃酒糟和植物饲料长大，从猪仔到出栏要1年多时间，并且最大的猪也只有200斤，所以猪肉口感好，深受消费者欢迎。”
樊鹏飞办完所有手续，开始养种猪。很快，他在广西5个市发展了200多个农户加盟，猪苗由樊鹏飞提供，并按照他规定的“食谱”饲养，出栏的生猪则由他统一收购。
据记者了解，樊鹏飞创建的“回原”牌土猪肉正在逐步打开市场，专卖店的价格高达每斤38元，比普通猪肉贵一倍还多。“尽管如此，规模太小还是赔钱，钢构厂和养猪场一起搞，是为了以工补养。”樊鹏飞介绍说。
正当樊鹏飞踌躇满志、准备在养猪业大干一场时，柳江县住房和城乡建设局的“拆违”通知书不期而至。
“未经城市规划许可，在鱼种场扩建厂房的行为违法，限期拆除违法建筑。”樊鹏飞2012年6月收到了行政处罚告知书；同年7月，他又收到住建局的“处罚决定书”，限其在收到本决定书之日起，立即拆除违法建筑；2013年5月6日，住建局再发催告书，要求三日内自觉履行拆除决定。但通知书并未表明具体哪些建筑违法。
樊鹏飞思忖：批准的临建厂房使用期限为两年，逾期住建局拒办延长手续，可能成了违法建筑，但证照齐全的企业寿命不能只有两年吧？你前批后不批，不是故意刁难外来投资商吗？他又想，原址建起的养殖大棚属违法建筑？可养殖场搞养殖有什么错呢？
樊鹏飞说，每次收到住建局的通知，都派人带上书面材料去说明情况，然后住建局就没了下文，直到今年6月14日突然遭野蛮强拆。“这是做梦都没有想到的”。樊鹏飞一再说道。
厂房顷刻成废墟
钢管弯曲，铁瓦翻卷，相互纠缠在一起，覆盖了整个厂区，乍看像遭遇了台风地震，细看又像是废旧金属收购站。在柳州市柳邕路(柳江段)塘头村地界的一处洼地里，樊鹏飞的钢构厂和养猪场变成了现在的模样。
“除了养着活猪的两个厂棚让我们自行拆除外，其他能拆的都拆了，足有4万多平方米。”樊鹏飞对记者说，车间厂棚全部是钢管、槽钢和铁瓦组成的临时建筑，这些建筑都能拆掉重新组装使用，这种破坏式的强拆损失太大了。“5个月了，我一直保留现场，想让柳江县给个说法”。樊鹏飞坦言。
“6月14日上午7点多，突然来了100多名穿城管或公安制服的人，手里拿着盾牌警棍，把我们赶出厂区，宿舍或办公室的私人用品也不许拿，只能站在警戒线外，眼睁睁地看着5台钩机铁臂挥舞，厂子被拆，机器设备、办公用具和私人物品全被砸埋到废墟中。”员工刘先剑对记者介绍说。
鲁支林是一名老党员，厂区的负责人，他告诉记者，围墙是水产饲料厂几十年前建的，后有修补，也被大段大段捣毁，外部人员趁虚而入，抢走了不少东西。
“不但如此，水产饲料厂刚成立时建的办公楼、宿舍，2000多平方米呢，也被拆掉了，那是属于柳州市的国有资产。”水产饲料厂厂长陆美发也表示不解。
记者看到事后樊鹏飞方列出的公司及个人损失清单，A4的纸，密密麻麻有20多张，直接损失3000多万元。
柳州市一位律师告诉记者，政府部门在决定对违建强拆前，必须予以公告，并作出强制执行决定，柳江县住建局的做法显然违法，也缺乏人性化。
法治周末记者就相关问题到柳江县住建局采访，办公室负责人覃保华经请示领导，让记者到市容局找林海泉局长解答，“他也是住建局的副局长”。
记者在柳江县市容局等了一下午，未能见到林局长，第二天电话联系上其本人，林海泉说：“我们的执法没有问题，都是合理合法的，但细节的文字性的材料不方便给你看……”此时，电话不知何故中断，记者再拨通林海泉手机时，他不接了。
“半年来只拆了他一家”
厂子被强拆后，樊鹏飞百思不得其解，无论承包还是租赁，自己接手的是几十年的老厂区，位置偏僻，建的车间厂棚又全是临时建筑，怎么会影响到市容市貌、影响到柳江县的城市规划呢？
他只知道，自从有重点项目修到厂子旁边的传闻后，企业的路子便不顺畅了。“现在重点项目正在修建，昔日的烂泥塘将变成黄金宝地，令多少人眼馋，而我的合同2032年才能到期，他们等不及了。”樊鹏飞坦言，这些只是猜测，否则那么多违建不拆，偏偏拆他的呢？
6月14日强拆三升公司的事件，被当地多家媒体报道，其中一家刊登的文章是这么说的：此次拆除三升公司两违建筑面积6.8万平方米，占该县今年10万平方米拆违任务的68%，是该县打击违法用地、违法建设行动以来，向单一违法当事人实行一次性强拆的历史之最。
从这篇报道的字里行间，樊鹏飞看到，柳江县有拆违任务，“半年来只拆了他一家”。
樊鹏飞说，养殖业本来是国家政策扶持的产业，但他的养殖场不仅没有享受到什么优惠，反而遭到了灭顶之灾。
