  新华网广州11月13日电(记者 李建国、邱明)为了一个号称能带动当地发展的“温泉旅游”项目,2007年,广东省的英德市曾编造虚假材料骗取批文,被国土部通报查处。岂料,近日,村民反映,当地横石塘镇再次编造不实材料,把村民“只租不征”的集体土地变为国有,并拍卖给该项目开发商。


  在当地基层官员眼里,“仙湖温泉”项目的土地违法现象,仅被视为是“一些瑕疵不可避免”。横石塘镇国土所所长潘岐赞甚至认为,“没有先征地,怎么可能去批地”?


  “只租不征”的农地“变脸”成“国有”


  事发突然。去年年底,横石塘镇新群村委张贴出一张土地确权公示,显示蓝屋等几个村民小组有集体土地被确权为国有土地,让村民大吃一惊。因为这几个村只签订了土地出租协议,怎么会“变出”国有土地?


  位于粤北山区的新群村一带风景秀丽,奇山异石林立,素有“小桂林”之称。这里发现地矿温泉后,当地政府为引进一个号称要打造“中国最具吸引力的温泉旅游度假胜地”——“仙湖温泉”项目,开始大面积“征租”农民的土地。


  蓝屋村大部分村民只同意租地。蓝屋村民小组长蓝定旺说,我们村的土地不多,当地政府当初想征用土地,并把部分村民请到镇政府草拟过一份征地协议,但大多数村民最终都不同意征地。为防范租地变征地,蓝屋村专门与镇政府补签了一份租地协议,注明此前草拟的征地协议作废。


  蓝屋村提供的租地协议显示:“蓝屋村民小组同意将全组土地租给横石塘镇政府用于温泉旅游开发,租期50年”,落款分别盖有横石塘镇政府和时任镇长的印章。在一份2005年5月18日签订的“补充协议”中,有一条款内容注明“2005年2月2签订的征用土地协议自然终止”。


  面对租地变征地,村民开始讨要说法。2013年6月底,蓝屋村拿到一份英德市国土部门的复函。该函确认蓝屋村已有306.22亩报批为国有土地;同时确认了蓝屋村集体土地“只租不征”的事实:“因村民反对,横石塘镇政府对上述土地实地租凭,签订了《补充协议》,注明终止2005年2月2日签订的《征地协议》”,但该复函回避了土地“变脸”是否合法。


  与蓝屋村同样遭遇的还有相邻的钟屋、荷树下村。村民很气愤,认为这是典型的“抢地”行为。


  国土部处罚形同一纸空文


  国家明令禁止不得违背农民意愿强征土地。2007年,国土部通报查处了英德市“编造21份虚假材料骗取国土批文1226.337 亩”的违法事实。广东省随后对7名当事责任人作出了撤职和党内严重警告等处分。


  此举不可谓不严厉,但当地有些职能部门并未从中汲取教训。英德市国土局提供的材料显示,在国土部查处后,当地随后三年内分批次申报城镇建设用地共获批了2054亩,并拍卖给了“仙湖温泉”项目开发商,这其中就包括了蓝屋、钟屋和荷村下三个自然村的集体土地约400亩。


  而其上报蓝屋村的征地协议,却是那份2005年2月2日签订的“作废协议”;钟屋、荷树下两村上报征地协议则盖的是新群村委会的章。但钟屋村民小组长李泽云、荷树下村民小组长李世明说,我们从未过签订也未听说这样一份征地协议。


  这意味着,就在国土部通令查处不久,横石塘镇依旧编造“虚假无效的材料”作为申报国土批文的依据,并一路绿灯地“骗征”了农民的土地。


  国土报批要经历各级审核共十几道关口,却没能挡住虚假报批材料。事实上,蓝屋、钟屋和荷树下三个村是否签订“租地”协议?征地协议是否经由所在地村民同意并盖所征村集体公章?这些问题其实并不难以核实。


  横石塘镇党委书记肖启纯说,地方迎来一个大项目不容易。我们也想好好与村民把征地谈下来,但现在的征地补偿价格不稳定。村民的期望也一直在变,有时也只能边做边谈,否则项目发展难以保障。


  把村民的集体出租地报批为国有建设用地显然不合规。英德市国土局局长钱金勤说,作为国土职能部门有审核不严格的责任。他解释,国土报批材料往往堆积如山,国土职能部门的工作人员通常人手不够,有时难以逐一核实。


  村民担心“抢地”连片上演


  “仙湖温泉”项目如今正在加快推进建设。蓝屋村村民担心土地还能不能拿回来,更害怕又出现集体土地被不明不白地抢去的情况。与蓝屋村村民一样忧心忡忡的,还有钟屋、荷树下等当地20多个村上千名村民。


  事实上,“仙湖温泉”项目土地需求巨大。2009年,英德市官方公布的环评文件显示其控制面积达12886亩。而在2007年国土部查处时,当地政府便实际控制了6763.94亩土地,其中“未批先征”达4222亩土地,租用集体土地2541.94亩,涉及周边20多个自然村。


  村民的担心是有理由的。按规定,“未批先征”的土地应该返回村民耕种,但实际上,“仙湖温泉”项目已把这些土地圈成一个面积巨大的控制范围,四周通往路口已设有专人把守,里面居然还包括了当地村民没有“征租”的山地。


  “我们有近2000亩没有出租的林地被圈占了,如今想去自家的地也去不了。”蓝定旺说。


  与此相对应,失地村民的生活状况令人担忧。蓝屋、钟屋和荷树下等村是整村搬迁,村民散落四方。


  在钟屋村一处安置点,记者看到不少村民的安置房渗漏严重。这些村民的稳定生活费,是当初出租协议上规定的“每人每月150元”,大部分村民生活保障十分困难。“土地对我们很重要,希望不要把它抢走。”村民说。
