从化市市政排水管理所所长刘在华打着给上级领导送礼的旗号，多年来虚报工程材料、捏造工程，套用公款40余万元。一审被法院判十年六个月。检察院抗诉，认为原审对第二宗事实认定有误。广州中院二审支持检察院抗诉意见，改判刘在华十年七个月。
刘在华现年45岁，大学文化水平。检方指控，从2007年至2009年，刘在华以给领导送礼为借口，分三次指使该所副所长郭文光，伙同从化市江埔小海水泥预制件厂的负责人刘某源，通过虚报沙井盖数目、虚开送货单、虚开发票金额的方式，套取公款共25万元。多位证人证实，赠送“礼金”一事从未经所会议讨论。而上级部门相关人士也证实，收取的慰问金多则500元，少的也就200元。检方指控，刘在华将套取的25万元公款大部分款项据为己有，构成贪污罪。
此外，检方指控2011年12月左右，刘在华同样以给上级领导送礼为由，指使郭文光与工程承包人钟灵青，虚构“城内路管道清淤工程”项目，伪造虚假材料，套取财政专项工程资金171744元，然后据为己有。
法院一审期间，刘在华当庭翻供，否定了第二单指控。因钟灵青在逃，法院认为案情不清，不予认定该项指控，仅认定第一单，遂决定对其判有期徒刑十年半。
宣判后，从化检察院不服，向广州市中院提起抗诉，称刘在华虚报清淤工程套取的17余万元已从公款账户中移出，转给钟灵青，已算贪污既遂。
广州市中院二审对大量证据进行排查，采信了抗诉意见。近日，中院改判刘在华有期徒刑十年七个月，并处没收财产人民币1万元。
