《十项措施》撑起司法公正
10月29日，省公安厅印发《河南省公安厅关于进一步加强和改进刑事执法工作切实防止冤假错案的十项措施》(以下简称《十项措施》)。
《十项措施》要求，所有刑事案件均要进行现场勘查，对刑事案件讯(询)问同步录音录像，准确固定言辞证据，案件移送审查起诉前，对证据的真实性、合法性及证明力进行严格审查，依法排除非法证据，补强合法证据。
公安系统也要重视网络，要求各地强力推行网上执法办案，所有案件一律在省市一体化警综平台执法办案与监督系统中办理。
措施中，最引人关注的是“强化执法质量考评结果运用”，严禁下达“刑事拘留数”、“发案数”、“破案率”、“退查率”等不科学、不合理考评指标，不得以破案率、批捕数、起诉数、退查率等指标搞排名。
其他措施还有：严格案件法律审核把关、切实保障律师执业权利、整治突出执法问题、全面落实执法责任终身制规定、加强执法制度建设、建立执法管理长效机制、全面提升执法主体能力。

出台《十项措施》，为了防止冤假错案
《十项措施》可使公安人员更规范自己的行为。
省公安厅法制总队负责人介绍，出台《十项措施》，既是为了落实中央有关部门的指示精神，也是为了解决河南公安执法实践中存在的突出问题，进一步加强和改进刑事执法办案工作，切实防止冤假错案的发生。
简单地说，这是为纠正执法行为，防止冤假错案。
公安系统老的执法质量考评办法，始于2001年。过去10多年中，包括破案率等在内的考评体系有力推动了公安机关整体执法质量和执法水平的提高。

破案率等指标，河南很久已不用
此次出台的《十项措施》，专门要求废除“刑事拘留数”、“发案数”、“破案率”、“退查率”等考评指标。
一位受访刑警告诉河南商报记者，以前这些指标存在时，会给他们造成很大压力，因为“一旦考核不合格，不但自己的工作成绩受影响，部门单位也会受影响”。同时，在这些指标指挥棒下，还容易出现问题，为了破案，采取一些非常手段，比如刑讯逼供等都可能出现。
其实，上述因素导致的后果，也是最被诟病的地方。
对此，省公安厅法制总队副总队长华列兵说，“实际上，河南公安已很长时间没有把破案率、刑拘数这样的生硬数值作为考评指标了，但命案侦破率还在考核序列当中。”破案率这项关系到公安单位、个人考评成绩的指标，在相当长一段时期内发挥了积极作用 ，“肯定是有利于案件的侦破的。”
河南命案侦破率连续7年全国第一

据了解，2004年之前河南命案侦破率只有60%左右，当年，为掌握命案侦破主动权，省公安厅党委明确要求，各级公安机关一把手是本地命案攻坚第一责任人，要亲自过问、靠前指挥。
2011年时任省公安厅厅长秦玉海在接受媒体采访时介绍，2010年全省命案侦破率达到97.57%， 河南的命案侦破综合成绩连续7年位居全国第一。
华列兵介绍，随着《十项措施》的出台，命案侦破率这一考核指标也废止了。
未来
公安工作更多靠执法质量考评
一些不合时宜的考核指标取消，众多公安系统人员松了口气。
可对老百姓来说，他们更担心的是，没有了这些破案指标，案件还会及时侦破吗？公安人员的积极性还能调动起来吗？
“取消破案率这样的指标，绝不代表取消对案件侦办的考评。”华列兵说，《十项措施》对这些都有考虑，措施将会有利于规范考评奖惩，推动形成正确的执法绩效观。
华列兵说，考评指标的改变不会对案件侦办带来负面影响，因为以后的考评是把群众满意度、执法质量当做主要指标，“如果你案子破得不够，侦破效率也不行，那群众就肯定不满意，仍会影响到最终的考评。”
他透露，可采用多种手段来获取考评信息，比如从网络上收集、委托社会机构进行调查、由权威部门进行科学分析等，包括办案上网，考评人员可以在网上看到办案情况。破案效率高不高，执法过程规范不规范，这些都会比那些单纯的数值更有说服力。

刑事拘留数、发案数、破案率、退查率等指标，是政府部门以提前想象的情况来约束考核基层机关，完不成指标就会受到相应惩罚。这看似一种颇严厉的政绩考核，实是管理懒政。这种以想当然为依据的指标管理懒政，显然不属于“治理现代化”的范畴。因此，废除破案率指标，真正以执法质量作为考核标准，是“治理现代化”的应有之义。 (河南商报)
