  江平:法治出问题市场不能“独善其身”

  12日公布的十八届三中全会公报提出,建设法治中国,必须深化司法体制改革,加快建设公正、高效、权威的社会主义司法制度,维护人民权益。让维护宪法法律权威,深化行政执法体制改革,确保依法、独立、公正行使审判权、检察权,健全司法权力运行机制,完善人权司法保障制度。


  “我一直坚持认为法治压倒一切。当前中国市场自由不够,市场秩序混乱,公权和私权之间冲突,出路是法治”。近日,法学家、中国政法大学终身教授江平接受《第一财经日报》记者采访时说。


  多年来,江平竭力为法治中国奔走呼吁。


  江平认为,现在谈的市场经济就是法治经济,其中包括两层含义:一是自由的经济,自由的法治,二是秩序的经济,秩序的法治。二者结合在一起,构成了完整的“法治与经济”的概念。


  市场经济的法治基础存在问题,市场不可能“独善其身”。但中国的法治之路注定曲折,要实现法治,只有依靠坚持不懈的努力。


  2003年《行政许可法》颁布实施,至今已逾十年。在新一届政府大力倡导转变政府职能、释放改革红利的当下,政府与市场的边界依旧在摸索中调整。


  “《行政许可法》是在实行中出了问题。在(《行政许可法》的)立法过程中,立法报告明确谈到,当事人自己能解决,尽量让自己解决,解决不了的由社会解决,当事人和社会都不能解决的再交给政府。但是实际情况呢?实施十年,执行过程中出现了问题,政府干预过多,并不尽如人意。”江平向记者谈到。


  江平认为,如果不能够确立“先市场、后社会、再政府”的正确顺序,那么中国的经济体制就不可能完善。


  尽管依“法”而治存在问题,但江平对本届政府执政后所释放的改革态度仍持有乐观态度,“从目前看,行政审批制度和行政体制改革在预期之中。”


  法治进程中,对政府权力的约束不仅在于清晰界定政府与市场的边界,更应体现在对权力的监督和约束,这便是司法独立的题中之义。坚持司法独立和公正,是依法执政、依法治国的根本要求。要实现司法独立,江平认为应首先使地方法院独立于地方政府,不受地方政府对审判的干预。


  江平认为,要确保法治统一,地方法院应由中央集中管理,包括核心的财政拨款和人事任免权回收到中央。


  “地方法院由中央集中管理,独立于地方政府,我是希望这个改革能够首先实现。”江平谈到,“因为这个改革并不意味着法院的完全独立,而是先独立于地方,独立于地方是司法独立的关键步骤。在地方,县长、县委书记给法院打招呼是司空见惯的事情,对法院的干预,往往地方更多,中央更少。所以我认为,法院绝对有必要先脱离地方,然后再谈法院的其他改革。”


  江平认为,现在地方法院受地方政法委领导,后者常以地区稳定为由,从而影响当地法院判案。若能将地方法院的权力收归中央,就可大大免除受地方以维稳为名的干扰。这样,法院就有可能不以地方稳定为依据和前提,从而实现公正判案。
