  “从实质上来讲,共同走访和群体性上访这两个概念是没有区别的,但群体性上访不能是法律概念,而是政策性的语言,共同走访是一个法律概念。”暨南大学副教授高轩说,在现实中,信访条例的规定缺乏可操作性,很多信访人不愿推举代表,这种情况下又没有别的途径去处理。


  暨大意见稿中拿出了专门的一节,对共同走访作出界定。共同走访采用预约受理的方式进行,须经信访工作机构登记受理。预约成功后,就可在规定的时间和地点进行走访。其中,10人以上必须推选代表人,代表不超过5人。代表人由共同走访人自愿推选,经2/3以上同意。若30日内无法产生代表人,信访终结,走访人可另行单独提出信访事项。意见稿中还规定,代表人在信访过程中变更、放弃信访请求,必须取得被代表的共同走访人同意。

  “谁产生的信访问题,就要承担责任,现在这么多的信访问题,没有几个人为信访‘埋过单’。”昨日讨论会上,深圳市委副秘书长、市信访局局长林超金表示,希望新制定的广东省信访条例从源头上抓起,建立“谁主管谁负责”的追责制度。


  林超金说,现在存在信访怪现状是,部门觉得自己已经走完了法律程序,“上访是老百姓的事,上访后是信访局的事”。在实际操作中,信访问题怎么处理,并没有统一的流程,结案也没有标准。林超金说,解决实际问题,还是要相关主管部门出手才行,主管部门通过政策手段,才能从根本上解决信访问题。


  在责任追究上,广州市海珠区信访局局长黄素平就认为应该建立重大信访问题倒查责任制。省人大内司委副主任委员朱穗生认为,建议稿中应当要增加对失职人员的行政责任追究条款。


  领导大接访?领导批示信访?

  有信访局长说自己常遇到“原告”和“被告”的批示都来了,真是左右为难。


  领导大接访也成为了与会专家拍砖的对象。3所高校的建议稿中不约而同都没有对领导接访进行具体的规定。中山大学课题组表示,目前对信访的处理主要靠领导批示,领导成了“信访专员”。要削弱信访作为化解矛盾的社会治理功能。因此没有规定领导人接访制度和信访联席制度,建议稿还将信访局督查督办的功能转移给了人大常委会的信访工作委员会。


  会议中唯一一名群众代表黄碧虹也表示不赞同领导亲自督办。因为不是每个人都能拿到领导的批示,这样会导致不公平。省人大常委会办公厅副巡视员钟焕新当了10年的信访局长,他说自己常遇到“原告”和“被告”的批示都来了,真是左右为难,建议草案要明确各级党委政府机关领导对信访事项不准提出有倾向性的意见。领导的批示对信访工作不利。甚至有可能容易产生腐败行为。


  立法咨询专家、省政府法制办原巡视员李华南持反对意见。认为国务院的信访条例第5条就规定了各级人民政府、县级以上人民政府各工作部门的负责人应当阅批重要来信、接待重要来访、听取信访工作汇报,研究解决信访工作中的突出问题。广东的地方性法规不能与国务院信访条例相冲突。在现实当中,领导接访是多了一条救济渠道。
