　　法院：王登朝指使截留保安工资

　　法院经审理查明，深圳市保安服务公司于2011年7月中标了深圳市供电局的三份大运安保合同，合同规定需派出保安员644人执行大运电力安保任务，市保安公司指派由王登朝任经理的保安七部履行。同时，祉庆物业管理公司也中标了大运安保合同。王登朝与祉庆物业管理公司负责人张某某约定，由王登朝调派保安人员帮助张某某完成祉庆公司的大运安保任务。张某某本欲与市保安公司签订正式合同，但被王登朝拒绝，王登朝要求张某某直接向其支付钱款。同时，为了招聘足够多的保安人员能够同时完成市保安公司和祉庆公司的任务，王登朝欺骗市保安公司，称合同中规定的644人是岗位数而非人数，需扩招保安人员至1627人才能完成任务。该申请获得批准。

　　在大运安保过程中，王登朝收受张某某给予的款项人民币278万元，调派市保安公司招聘的保安人员帮助张某某完成了祉庆公司的大运安保合同；此外，王登朝还利用市保安公司发放工资的漏洞，指使其下属宋某某截留保安员工资人民币1084400元，王登朝混杂使用这两部分现金款项。据现有证据显示，王登朝为大运安保项目花费的现金至多为人民币30 590 95 .7元，其将剩余款项人民币805304.3元据为己有。其中人民币10万元由张某某直接转账至王登朝前妻高某某账户，王登朝另支付人民币30万元为高某某购房。

　　大闹检察院妨害公务罪未获认定

　　法院另查明，在深圳市公安局纪委将涉嫌贪污的王登朝移送深圳市人民检察院调查之际，在深圳市人民检察院办案区域内，王登朝确有击打深圳市人民检察院办案人员庄某某的行为，也有大吵大闹扰乱深圳市检办公秩序的举动。但综观全案，王登朝的行为在较短时间内得到化解，王登朝妨害公务行为其手段强制性不明显，亦未造成严重后果，故对其行为不应以犯罪论处。

　　法院认为，上诉人王登朝身为国家工作人员，在履行大运安保任务过程中，利用职务上的便利，侵吞公共财物，其行为已构成贪污罪，一审认定王登朝贪污公款数额为人民币2831040元不当，依法应予以纠正，认定王登朝贪污数额为人民币805304.3元。原判认定王登朝犯妨害公务罪不当，依法予以纠正。
