　　诉讼的焦点是建设局是否“行政不作为”。郑女士认为，申请以来的一年多时间，建设局未对申请组织入户调查，未公示审查结果，自己亦未收到延长许可期理由的告知，也未收到给予许可或不予许可的正式决定。而建设局方面则认为，其对社会保障性住房家庭资格的审核，属于对申请者真实性和合法性的行政行为，不属于行政许可；厦门市第四、五批保障性商品房已经落实，第六批也发布预约落实公告，但原告未作登记。双方争执不下。经过11月8日一上午的审判后，法庭宣布择日再审。

　　但在去年第五批保障性商品房申请人看来，厦门岛内诸多房源已被厦门大学、中科院、华侨大学等事业单位囤积，当时其调查显示，位于岛内的滨水小区无分配明细却已售1311套、已租无明细336套，共1647套房源去向不明，“很多标明已出售的房子都还贴着封条，甚至整栋楼房都是空的”，初步计算，岛内共有2624套保障房去向不明。文/《羊城晚报》
