　　事情缘起于2011年7月，庆元县人吴某等人认为当地某河段采砂石料有较大利润，就以某公司名义与所在地村委会签订承包河道清理协议。2011年7月28日，以该村委会名义向庆元县水利局提出河道清淤申请。

　　时任庆元县水利局副局长的胡顺金，明知吴某等人名为清淤实为采砂且不符合申请资格的情况下，在2011年8月29日，超越职权并违规审批同意其申请。

　　规定期限(2011年底)届满后，吴某等人因故未能在规定的时间内完成采砂，又提出延长采砂期限申请，胡顺金又违反规定，同意申请，致该河段内砂石被继续开采。截止2012年6月，共采砂石计152402立方米。

　　法院查明，2011年8月至2012年6月，吴某等为让其同意审批河段采砂工程及感谢帮忙和与其搞好关系先后四次送给贿赂共计人民币90000元。

　　归案后，胡顺金退清了赃款。

　　法院经审理认为，被告人胡顺金在担任庆元县水利局副局长期间，利用职务便利，为他人谋取利益，非法收受他人贿赂人民币计90000元，其行为已构成受贿罪；明知吴某等人名为清淤实为采砂的情况下，超越职权并违反规定审批同意吴某等人要求对涉案河段河道进行清淤的申请，造成该河段的砂石被开采计152402立方米，国家资源遭受严重破坏，其行为已构成滥用职权罪。(完)
