  这15个人后来抱团,聘请北京律师王令打行政官司。2012年7月17日,王懿伟等15人以征收程序违法为由,联名将镜湖区政府告上法庭,请求依法撤销其作出的(2011)6号房屋征收决定。


  □诉讼



  多起“民告官”无一例胜诉


  这起15人联名诉讼案由芜湖中院指定三山区法院审理。镜湖区政府辩称,其征收目的、程序合法。法庭上,原告和被告各自出示证据,最终,2012年12月27日,法院一审宣判,驳回15名原告诉讼请求。


  对于一审结果,王令律师称在意料之中。除了坚持认为政府程序违法,王令指出判案存在瑕疵。


  此后15人选择上诉。在芜湖中院二审宣判之前,王令所在的律所邀请国内著名的行政法教授应松年、姜明安、余凌云、王锡锌、沈岿等5名专家,对王懿伟等15人的“民告官”案进行论证。最终,专家组给出“案涉征收决定违法”和“案涉征收补偿决定违法”两条法律意见,专家组意见被提交至法院。最终,二审维持原判。


  上述案件审理的同时,另一起5人联名诉讼也在进行。代理此案的南京律师邱建军介绍,5名原告分别持有征收红线范围内2栋工业厂房的产权。法庭上,他们指出,芜湖市规划局的批复程序违法,要求法院判决其撤销发给芜湖市建设投资有限公司的《建设用地规划许可证》。


  尽管一审、二审结果都支持芜湖市规划局,一审判决书还是指出了其行政行为上的“瑕疵”,称:“芜湖市发改委在没有被告核发《选址意见书》的前提下,即作出项目批复,进而被告向芜湖市建设投资有限公司核发《建设用地规划许可证》,被告的许可行为在时间顺序上存在瑕疵。”


  据记者了解,除上述两案,还有其他征收对象打行政官司,截至目前,无一起胜诉案例。

  红线图和面积存变化


  官司虽然输了,王令却对“火车站规划范围究竟多大”穷追不舍,并向芜湖市规划局申请信息公开。


  据芜湖媒体此前报道,火车站站区枢纽工程面积25万平方米。2011年,芜湖市发改委文号为发改投资(2011)436号的文件中也明确提到,总建筑面积约为25万平米。


  今年5月3日,芜湖市规划局向王令作出答复。该局2012年2月10日核发的芜湖火车站站区枢纽工程的《建设用地规划许可证》显示,枢纽工程占地面积为32.2万平方米,并附有红线图。


  11月4日,京华时报记者从镜湖区房屋征收办核实,站区枢纽工程征收总面积为44.3万平方米。与此相符的是镜湖区政府2011年9月28日的征收决定。该决定附红线图,落款时间为2010年9月20日,盖有芜湖市城乡规划局公章。征收办负责人宋陵生称,该图红线内面积即为44.3万平方米。


  对比两张红线图,能看到显著差异:规划许可证所附图,比征收决定所附图,要少划一个“大方块”。在前一张图中,汽配城只有部分楼房被纳入,而后一张图中,汽配城整体被纳入红线范围。


  一同被纳入“大方块”的,还有一栋4层的在建工程“旅游礼品大世界”,该楼还保持着4年前停工时未拆除脚手架的状态。投资人周仁杰是浙商。周仁杰称,他通过招商引资,办理正规手续拿下该地盖房,但2009年眼看就要完工时,政府突然通知停工。


  “去年,政府下达征收补偿决定,补偿费2.05亿,但自始至终,我只见到评估结果,没见过详细的评估报告。”周仁杰说,公司自己评估应赔7亿多元,在行政复议无果后,公司起诉区政府请求撤销其征收补偿决定,一审败诉后,目前已进入二审。


  多出的“大方块”如何理解?王令的分析是,政府在借助民生工程“搭车征收”。“如果用来搞商业开发,则完全没有理由征收。”他说。


  在征收决定所附红线图上,芜湖市规划局有文字注明:“根据芜湖站站区规划,经研究,同意按图示红线范围办理一期工程拆迁相关手续。”


  对于红线图的差异,宋陵生和镜湖区副区长许兰表示,他们严格按市规划局批准的征收红线范围征收,没有超规划红线。


  市规划局鲍副局长则称,给镜湖区政府的图,是方便其调查摸底的,按相关法规,该图并非征收房屋的前提要件,因此,具体的征收行为与规划部门无关。


  多征收的“大方块”今后如何规划,镜湖区政府和芜湖市规划局均未解释。

  是否搭车征收储地出让


  事实上,关于芜湖站站区规划,还有一个“2.5平方公里(也即250万平方米)”的说法,它是站区枢纽工程原规划面积的10倍。


  《芜湖日报》2009年12月25日的报道称:“市铁路项目建设领导小组对芜湖火车站站区的初步设计进行了评审……芜湖火车站站区规划面积为2.5平方公里。”2010年6月3日报道称,关于火车站扩建工程,“市发改委相关负责同志告诉记者,围绕新火车站还将打造一个2.5平方公里(即250万平方米)的核心商圈。”


  芜湖市发改委2011年436号文件中也提及:“该项目以芜湖火车站站房为核心,东至弋江北路,南至赭山中路,西至九华中路,北至赤铸山东路,约2.5平方公里。”镜湖区房屋征收办2011年8月11日制定的《火车站站区枢纽工程项目征收补偿方案(征求意见稿)》,关于“征收范围”也明确提到这个“2.5平方公里”。


  宋陵生解释,补偿方案并非正式文件,且文中所述2.5平方公里是马路的大致面积,并非实际征收范围。


  芜湖市委宣传部相关负责人称:经与市规划局、市发改委沟通,两部门均未下发过关于“2.5平方公里”的正式文件。


  尽管无明确规划,环火车站2.5平方公里范围内的经济业态,或多或少受政府控制。在此次征收红线之外,通过招商引资进入芜湖的浙商张黎明盖起一座商业广场,虽已完成大部分装修,但却无法招商。张黎明说,其商场在2009年被勒令停工,相关部门后来一直不发预售许可证和验收,致其进退维谷。


  对此,副区长许兰表示,市里确实有所控制。


  据了解,芜湖火车站站区枢纽工程(东广场)一期工程,在2012年即被确定为芜湖市一号重点工程。就“环火车站今后将如何规划”问题,记者先后接触镜湖区政府、芜湖市重点工程建设管理局和芜湖市规划局,均未得到答案。


  王令质疑,芜湖市在利用火车站枢纽工程多征收土地用于储备,以待将来出让土地获利。在信息公开申请时,他曾问及火车站东广场周边土地的规划用途。芜湖市规划局回复:“今后我局将结合站区枢纽统一制定规划,目前无法提供。”
