上海市高级人民法院当日公布6起危害食品安全犯罪典型案例。据其透露，此系“两高”《关于办理危害食品安全刑事案件适用法律若干问题的解释》实施后首批集中宣判的案件。
上海市高院副院长邹碧华同日对记者表示，法院将依法从严惩处危害食品安全犯罪，形成从严打击危害食品安全犯罪的高压态势。对危害食品安全犯罪将从重定罪、主刑从重、财产刑从重，同时严格控制非监禁刑适用。
在该批案件中，有些食品企业本应严守食品安全的法律规范，却明知故犯，实施了危害食品安全犯罪活动。同时，无证小作坊、小店面的违法行为，影响人群范围较广，严重危害消费者的身体健康。
上海高院方面表示，今后对于危害食品安全犯罪行为同时又构成生产、销售伪劣产品罪、非法经营罪、侵犯知识产权犯罪等情况，将依照处罚较重的规定定罪处罚。对危害食品安全犯罪的累犯、惯犯，犯罪集团的首要分子，共同犯罪的主犯、主要获利者，严重危害人体健康，销售金额巨大，以及处于生产、销售源头的犯罪分子，将依法从严惩处。对于从事危害食品安全犯罪的公司、企业，依法从严追究有关单位和直接责任人员的责任。
此外，将及时发布危害食品安全犯罪典型案例，对案件审判中发现的食品安全监管漏洞，将及时向相关部门发送司法建议。(完)
