东莞燃料原董事长李志荣被控受贿过千万，检方认为买房额外优惠均系贿赂
昨日，东莞市燃料工业总公司原董事长兼东莞新奥燃气有限公司原董事长李志荣涉嫌受贿一案在东莞市中级人民法院连续第二日开庭，李志荣被控利用职务之便为他人谋取利益，受贿1000多万元。
承揽了所在公司常规项目
检察机关指控，2009年至2012年，东莞市燃料工业总公司(下称“东莞燃料”)原董事长兼东莞新奥燃气有限公司(下称“东莞新奥”)原董事长李志荣，东莞燃料原副总经理、东莞市管道煤气工程公司(下称“东莞管道煤气”)原总经理兼东莞新奥燃气原董事吴世忠在担任东莞新奥董事长和董事期间，利用职务便利收受贿赂，为他人谋取利益，其中李、吴伙同他人共同收受河北×公司贿赂款1864万余元，李志荣个人收受广东某房地产企业集团有限公司(下称“某房地产集团”)贿赂636万余元。2007年，河北×公司为了承揽东莞新奥的工程，向李志荣、吴世忠提议成立东莞新某公司，以新某公司为名承揽东莞新奥的工程，李志荣表示同意，并安排吴世忠负责相关事宜。
随后，李志荣、吴世忠等人先成立了东莞德溢公司(其中李志荣、吴世忠占股55%)，再以该公司与河北×公司的名义共同入股东莞新某公司。东莞新某公司成立后，承揽了东莞新奥的常规工程项目，但由于缺乏相关施工资质，转手将工程全包给河北×公司的关联公司即东莞×公司(名义上提供所谓协调服务)，李志荣、吴世忠则凭空从工程利润中分成。
2009年至2012年期间，河北×公司以利润分红款名义送给李志荣、吴世忠等人共计1864万余元，其中，李志荣分得660万余元，吴世忠分得493万元。
拿低价天然气获买房优惠
某房地产集团于2009年4月投资成立东莞市小巴运输有限公司(下称“小巴公司”)，为降低运营成本，某房地产集团经营者找到李志荣，请求按照居民用气3.6元/立方米的低价向小巴公司供应车用天然气，并承诺给予好处，李志荣同意，双方就此签订供销合同。
2011年1月，李志荣以明显低于市场的价格向某房地产集团购买某楼盘13栋20号、21号两套房产，获得额外优惠分别是140万余元和163万余元。同年12月，李志荣又以明显低于市场的价格向某房地产集团购买某楼盘15幢3002房，获得额外优惠333万余元。上述额外优惠均系贿赂，共计636万余元。
检察机关认为，被告人李志荣、吴世忠利用职务上的便利，非法收受他人财物，为他人谋取利益，犯罪事实清楚，证据确实充分，均应以受贿罪追究其刑事责任。
