  1 久摇不中者能否获倾斜?

  2 能否以家庭为单位摇号?


  全国政协委员、中国科学院院士、清华大学教授孟安明说,目前摇号政策看似公平、机会均等,但他身边有很多家庭,有两辆车了还要参与摇号,并且摇中买了第三辆车,而很多无车家庭,摇号一两年空手而归。


  他建议,应根据家庭拥有车的数量,进行分类摇号,“优先权应该给那些一辆车都没有的刚需家庭。”


  孟安明认为,相关职能部门可以规定:对拥有两辆车的家庭,禁止其任何成员再参与小客车摇号,而对于拥有一辆车,还想再摇号的家庭,在摇号时可以赋予其稍低些的摇号概率,如10%,对于无车的刚需家庭,在摇号时则特别赋予其稍高些的摇号概率,如30%。至于如何甄别家庭拥有车的数量,以及如何赋予各类家庭不同的摇号概率,技术上可以想办法,并不是难事。


  3 摇号会和停车位挂钩吗?


  此前有报道称,北京市交通部门已经提议,拟完善本市机动车停车泊位“一车一位一编号”数据库建设,把拥有(购买或租赁)停车泊位作为申请小客车摇号的资格审核条件之一。


  美国3E交通系统咨询公司高级咨询专家徐康明认为,将正规车位作为购买小汽车的基本前提,是国外一些大城市控制小汽车增长的一项措施,但这项措施是否适合中国的国情,还需认真研究。不过从北京的角度来讲,探索以车位来限制购车的可行性很有必要。


  徐康明表示,这项措施的实施要特别慎重,要避免虚假停车证明以及倒卖证明的现象发生,“这项措施在实施之前,需要有大量的数据调查和配套的政策、体制方面的研究,我个人认为在短期内实施的可能性不大。”


  4 增设郊区车牌可行吗?


  “交通委反馈给我的信息是,对这个很感兴趣,也想向有关市领导反映。”北京市政协委员、中国石油大学教授张强斌口中的“这个”,指的是其关于增设郊区车牌的提案。

  张强斌承认,目前愿意承担郊区车牌不能进市中心代价的市民数量不多,但如有医疗、教育资源的系列配套政策支持,并坚持下去,就会像纽约、东京等大都市那样,郊区能吸引更多在中心城区的企业和市民自愿搬去。

  资源分配类 措施应公示


  中国社科院法学所研究员莫纪宏认为,北京即将出台新的机动车指标配置办法,这是一种涉及公共资源分配的行政措施,在实施前应该经过比较透明的制定以及公示、征求意见过程。


  2010年,北京市公布摇号政策前,在政府网站对外公布了缓解拥堵工作的若干工作意见,经过一周的征求意见,相关部门也公布了公众的反馈情况。莫纪宏说,这就是一种行政措施实施前征求意见的过程,按照行政许可法,类似比较重大的涉及公众利益的政策,应该广泛征求民意,或通过公示,或通过其他意见渠道集纳民众的意见和建议,这也有利于公共政策的有效推行。


  相关部门可能考虑到这样的措施比较敏感,提前公示会影响政策制定,所以没有走这个程序。行政许可法并没有在是和否之间进行明确界定,到底哪些行政行为需要公示,所以不好说这种做法是否存在问题。不过,相关部门也可以在事前多方征求人大代表的意见,或通过媒体达到公示的目的。“这之前几次发布会透露的信息,也算是一种公示。”
