近期被热炒的“团购越南新娘”活动引起关注。公安部刑侦局打拐办主任陈士渠近日表态，虽然我国对涉外婚姻并没有禁止性的规定，但对涉外婚姻中介机构有明确的禁止性规定，禁止成立任何涉外婚姻中介机构，任何人不得以欺骗手段或以盈利为目的，实施或变相实施涉外婚姻介绍活动。
陈士渠同时表示，针对一些网站和中介机构，打着介绍涉外婚姻的旗号非法盈利的行为，公安部将会同外交部、民政部，严厉打击这种非法活动。
“团购越南新娘”发端于几天前的11月11日，民间俗称的“光棍节”期间，一家著名团购网站，发起了一项“0元抽奖”活动，奖品是“往返越南相亲路费”。网站在活动说明中号召：“去越南找个不图房子不图车子的新娘吧！”
《法制日报》记者查阅发现，该活动至少吸引了2.8万余人参加。媒体纷纷以“网站发起团购越南新娘活动引万人参与”为题报道，引发“越南新娘”讨论热潮。
团购越南新娘引关注
“网站发起团购越南新娘”事件，最终以这家网站向媒体发出的一纸声明结束。
该声明称，由于活动介绍不够清晰，这项活动被误读。活动实为网站上常规的一个抽奖活动，仅为网友提供一个去越南旅游寻找真爱的机会，报销往返的路费。
该网站称，他们从不提供涉外婚介面的业务或服务，只鼓励网友在活动期间通过合法、自由的方式收获自己的爱情并予以法律允许范围内的资助。
尽管这次的活动是一场误读，但《法制日报》记者调查发现，在其他一些网站和地方，真实的“团购越南新娘”活动是存在的。
在百度“越南新娘”贴吧，大量实名账号均打出了提供介绍越南新娘的广告，并专门成立了QQ交流群。
北京的贺先生，曾有过通过此类婚介机构前往越南相亲的经历。他向记者介绍了此类机构的操作方式。
50岁的贺先生有过一段自称为“不幸的婚史”。在去年10月结束了该段婚姻后，他看到了网上一条越南新娘中介广告，觉得十分符合自己内心的要求。
贺先生向《法制日报》记者回忆，开始留意后，他发现越南新娘中介一般都会抛出许多成功案例，在网上发出案例当事人与越南新娘的照片。
记者看到，在百度“越南新娘”吧里，这样的案例广告有很多。
贺先生最终选择了一家“台湾背景、有十年越南新娘业务经验”的中介公司。记者随后在网上看到了该公司的介绍，据描述，“该公司创立于1991年，已为需求越南新娘的广大民众成功媒合不计其数佳偶，造就美满幸福婚姻”。
从官方介绍可以看出，上世纪90年代初，该公司先在越南注册了公司，后又分别在国内和台湾注册了办事处。
这家公司给贺先生开出了3万元的价码，并表示可以分期付款，会签订合同。不久后，在中介的带领下，贺先生前往越南，与该公司越南总部中介接上头。随后，几名越南中介安排贺先生和其他大陆相亲人员一起见了一些越南女孩。贺先生最终选中了一名21岁的越南女孩。
次日中午，中介安排贺先生和另外两对相亲人员举行了集体婚礼。贺先生介绍，如果没有什么意外，一次完整的赴越南相亲就完成了，办完相关手续后，越南新娘即可带回国内。
记者查阅多家提供“赴越南相亲”服务的公司介绍，程序与贺先生描述都没有多大差异。
除了此类明确给男士介绍“越南新娘”的婚介机构，《法制日报》记者发现，近年来，随着网络交友社区兴起，很多此类交友网站也明确打出“跨国婚介”广告，服务项目则局限于为国内女性介绍异国男士。
记者以相亲者身份在网上与三家此类平台取得联系，他们均明确表示拥有实体婚介公司，提供涉外婚介服务，网络只是其业务展示平台。
引发诸多社会问题
贺先生在越南相亲的第一个新娘，只有21岁，这一度让他十分兴奋。但仅在结婚第二天，当他吻了新娘一下后，这名新娘突然情绪大变，当晚就和家人拉着行李箱走了。
几天后，越方的中介人员告诉贺先生，由于他对新娘施用了暴力，新娘不会回来了，让贺先生重新相亲。贺先生要求退钱，被中介拒绝。在中介劝说下，贺先生最后再交2万元左右重新相亲。
这次，他看中一个30岁的新娘。但带回北京不到20天，这名新娘再次跑了。
无奈之下，他在贴吧上发帖：“越南新娘，我心中的痛！”他决定站出来揭露黑中介诈骗，“为了后来的人不再上当”。
《法制日报》记者查阅资料发现，此类诈骗在国内已屡屡发生。2008年轰动全国的“易广联”非法经营案就是其中典型。
当年3月至次年9月，广州、长春、昆明、宁波等地的易广联婚姻咨询有限公司陆续因非法从事涉外婚介而被查处，相关企业负责人因非法经营被判刑。
事后司法机关通报，仅东北地区就有近百名被害者，她们平均向“易广联”交纳过3至5万元。广州“易广联”案涉案金额更是高达人民币1511万余元。
问题远不止于此。福建省漳平市政府在2011年专门下发通知，要求严厉打击涉外婚姻介绍机构。通知称：“近年来，我市发现不少从事涉外婚姻介绍的机构或个人，为了牟取暴利，串通境外人员，借介绍婚姻之名，将境外妇女介绍给我市市民做新娘，因当事人彼此不够了解、感情基础不牢、生活习惯不同、语言交流不畅、患严重传染病等原因，给家庭及夫妻双方带来痛苦，也出现了骗婚、逃婚、离婚、女方回越南探亲久久不归等问题，以及非法入境、非法居留、非法就业事件，扰乱了正常的社会秩序。”
此外，因介绍越南新娘而引发的拐卖妇女现象也时有发生。
无法可依状态待改
《法制日报》记者发现，早在1994年12月6日，国务院办公厅就专门下发《关于加强涉外婚姻介绍管理的通知》，通知称，一些从事涉外婚姻介绍的机构及某些不法分子为牟取暴利，串通境外人员，借介绍婚姻之名，将我国一些妇女骗出境外，酿成不少悲剧，严重损害了我国的民族尊严和民族感情。
据此，国务院办公厅作出了十分严厉的规定：“严禁成立涉外婚姻介绍机构。国内婚姻介绍机构和其他任何单位都不得从事或变相从事涉外婚姻介绍业务。任何个人不得采取欺骗手段或以营利为目的从事或变相从事涉外婚姻介绍活动。”
对已成立的从事或变相从事涉外婚姻介绍的机构，国务院办公厅要求，由民政部门会同公安、工商行政管理部门联合进行清查，一经查出，坚决取缔；对在婚姻介绍活动中采取欺骗手段或牟取暴利造成严重后果的直接责任者，要由司法机关依法惩处。
然而，如前文所述，在国家明令禁止之下，许多涉外婚姻机构仍野蛮地存在着。广东省深圳市社会科学院教授杨立勋很早即对这个现象进行了研究。
杨立勋告诉《法制日报》记者，中国的涉外婚介面临着几大尴尬，分别是：涉外交友业务合法与涉外婚介业务非法的矛盾、爱情无国界与婚介有国界的矛盾、国家禁止涉外婚介与涉外婚介市场火爆的矛盾、涉外婚介禁与疏的矛盾等。
在百度“越南新娘”贴吧，吧主开了一个认证帖，要求所有在贴吧中介绍越南新娘的中介，都要发布自己的营业执照和身份证在该帖下面，由吧主和网友们进行认证。
这一举措受到了贴吧内网友们的广泛好评。一名网友评论，民间需求新娘的量是很庞大的，既然这个需求无法禁绝，那就要把它管起来。
杨立勋的建议也是，目前涉外婚介没有专门的法律法规规范，处于无法可依状况，应积极展开涉外婚介的立法研究，可先出台涉外婚介机构管理暂行办法，把涉外婚介纳入规范化、制度化、长效化管理中。
