记者搜索“小区短信基站”字样，可见658万个相关结果，其中，大量网址含有收费发送商业短信的内容。伪基站发送垃圾短信的报价，从每天四五千元到上万元不等。
声称在大兴区专销伪基站的某公司李姓业务员称，公司专门生产伪基站，价格根据设备性能而定，“最便宜的3万元，验货后当面付款。”
李女士称，从她手里购买伪基站的以往多是大商场，现在更多的是中小商家，“这东西一次性投资，无限量发送。”
“其实伪基站并不难查。”郭鹏说，他的客户里，大多是连同联系电话一同发送，“查他们，狠罚他们，没人敢使这东西，我肯定失业。”
垃圾短信之危
今年3月，安徽蚌埠市民王女士接到在外地做生意丈夫的电话，让她汇200万元到两个银行账户上，收到丈夫发来的第一个账号后，她将第一笔100万汇出。
此时，她的手机突然没了信号，接着就收到了一条短信，上面写着银行账号。王未经核实，就把第二笔100万给汇了出去。
直到接到丈夫发来的第二个银行账户短信，她才发现被骗。
据360手机卫士发布的《2013年第三季度手机安全报告》测算，垃圾短信已成巨大产业链，我国垃圾短信、骚扰电话所产生的话费可能已超百亿元。对垃圾短信的分类显示，广告推销类垃圾短信最多，诈骗类短信危害最大。
据不完全统计，仅今年上半年，诈骗短信就给全国手机用户造成超过3000万元的经济损失。
“诈骗造成的损失是可见的，类似移动伪基站这样的垃圾短信发送方式，对公共频谱资源的干扰造成损失则难以计算。”北京邮电大学经济管理学院教授、博士生导师曾剑秋说，伪基站具备接收和发送信号的功能，手机用户的信号被伪基站屏蔽后，手机会发送自动搜索周围基站的信号，此信号被伪基站获取后，伪基站开始能够分析出手机号码，之后将垃圾短信推送到用户的手机上。
“伪基站群发的信息，有的是商业广告，有的则违法、危害公共利益，这种行为必须禁止。”曾剑秋认为，不法人员利用伪基站发送短信，屏蔽信号，干扰公共频率资源，破坏公共秩序，如波及面广，危害后果严重，将会触犯刑法。
曾剑秋称，伪基站发送的信号被监管部门发现、处理，在技术上不存在难度。只要相关部门切实作为，这种形式的垃圾短信不可能频频作恶。
伪基站群发短信或触犯刑法
“我的手机上垃圾短信也占了很大比例。”今年10月，在第三季度我国工业和通信业发展情况发布会上，工信部通信发展司副司长祝军介绍，今年1至9月，工信部累计处理违规短信群发端口5万余件次，处理违规个人号码4.3万余件次。
北京市通信管理局信息安全处副处长朱文君曾表示，当前，治理垃圾短信过程中，伪基站问题日益突出。“其可以不经过基础电信网络发送，并伪造端口或伪造手机号码，在人流、车流密集的地方就可以实现发送。”朱文君说，“调查、取证、打击都很困难。”
治理街边“移动”伪基站的，包括北京市通信管理局、各大通信运营商、公安、工商等部门。
北京市公安局治安管理总队一位警官表示，伪基站群发垃圾短信，是否由公安部门管理，需要根据短信内容判断。
该警官说，如短信内容涉及商业广告、促销等行为，这些企业的行为应属工商部门管理；如内容涉及招嫖卖淫、诈骗、倒卖枪支等违法行为，警方将依法打击。
事实上，利用伪基站群发垃圾短信并非如郭鹏所说“管不住，查不着”。
11月初，深圳警方以涉嫌破坏公用电信设施罪名，刑拘两名在某楼盘群发30余万条广告短信的嫌疑人。
今年8月，公安部部署指挥北京等多地公安机关集中行动，捣毁“伪基站”设备生产“窝点”4处，缴获“伪基站”设备96套。
今年9月9日，福建省三级公安机关刑侦、技侦、网安等部门联合行动，在泉州、厦门控制20名违法犯罪嫌疑人，查获伪基站设备3套、电脑19台，破获泉州腾星信息技术有限公司利用伪基站非法经营案。
11月15日，北京市通信管理局电信管理处一名孟姓工作人员称，作为监管部门，市民发现伪基站或伪基站推送的垃圾短信，可向他们举报。新京报记者就暗访所获信息向孟举报，孟先生称，他们将会协同工商、交通等部门调查，根据信访条例，60个工作日内给予答复。
昨日，中国移动客服接线人员称，中国移动有义务处理伪基站群发垃圾短信的行为，记录相关信息后，接线人员表示，将向上级部门反映。
中国联通客服人员亦表示，会把此事向上级汇报。
专家及业内人士提醒广大手机用户，手机信号突然消失之际，或许就是伪基站群发短信入侵之时，用户对此时而至的短信要留神，切莫中了诈骗短信的圈套。

■ 法律法规
2006年12月1日起施行的《北京市无线电管理办法》规定：
第三十四条 销售不符合国家无线电管理有关规定或者技术标准的无线电发射设备的，由工商行政管理部门依法处罚。
第三十五条 违反国家规定，故意干扰无线电业务正常进行的，或对正常运行的无线电台(站)产生有害干扰，经市无线电管理机构依法给予行政处罚后，拒不采取有效措施消除的，由公安机关依照《中华人民共和国治安管理处罚法》第二十八条的规定给予相应处罚。
第三十六条 违反国家规定，擅自设置、使用无线电台(站)，或者擅自占用频率，经责令停止使用后拒不停止使用，干扰无线电通讯正常进行，造成严重后果，构成犯罪的，依法追究刑事责任。
■ 美国案例
垃圾短信每条被索赔500美元
外国也有垃圾短信，据媒体报道：美国很早就认识到垃圾短信的危害，并制定了两部处理垃圾短信的法律，禁止向消费者发送有关商业产品、服务和广告推广的垃圾短信，除非用户已经同意接收这些信息，或这些信息被用于紧急目的。
今年，美国消费者抱怨说，在订购某品牌比萨饼后，手机响个不停，推销该品牌特价比萨饼的短信一个接一个，有时会在半夜收到十多条同类短信。这些消费者提出2.5亿美元赔偿金的要求，平均每条短信索赔500美元。今年5月，该品牌所属企业同意赔偿1650万美元的和解方案，以了结官司。
观察家
要根治“伪基站”，还需要从抑制其市场需求入手。这需要通过立法渠道，大大提高发送垃圾短信的违法成本。
近日，《新京报》记者调查，北京街头出现短信群发商，他们会开着车，载着一种叫伪基站的短信群发设备，根据商家的要求群发广告、违法短信，而周边几百米的人群，手机若无防护，则无一幸免。一位短信群发商透露，仅他所知，至少有二十几拨人跟他是同行，每拨人手里的伪基站数量都不止一台。
记者调查到的问题并非孤例，近两年，各地不断爆出“伪基站”的新闻。今年8月媒体曾报道，公安部部署指挥12省区市公安机关集中行动，摧毁利用“伪基站”设备作案的违法犯罪团伙72个。
“伪基站”群发垃圾短信为何如此猖獗？这当然与“伪基站”作案隐蔽有很大关系。不过真要查，并不缺方法。比如“伪基站”设备的销售，许多都通过网络，“伪基站”招揽短信群发业务，同样也大多通过网络，如果相关部门加强对相关网络销售和广告的监管，这些违法销售信息就不会堂而皇之在网上流传。
比如，流动的“伪基站”难以查到，可是雇用“伪基站”群发广告短信的商家，许多有电话有地址，一查一个准。如果工商等部门对于这些违法发布广告的商家严厉处罚，那么，一些“伪基站”将面临“断粮”，这将大大限制它们的生存空间。那位短信群发商就告诉《新京报》记者，“查他们(商家)，狠罚他们，没人敢使这东西，我肯定失业。”
“伪基站”的猖獗，一定程度上，折射出一些部门的怠于作为。现实中，“伪基站”违法群发短信，通信管理、工商、公安等部门都有查处之责，但实际的情况却是，多家管往往意味着没人管，这些部门间缺乏一套执法的沟通和协作机制，导致没能形成打击的合力。
除了执法不到位，违法成本低，同样是垃圾短信、“伪基站”猖獗的重要原因。事实上，打击“伪基站”这样的社会溃疡，即便各执法部门联合打击，也会面临打击之后“死灰复燃”的问题。所以，要根治“伪基站”，还需要从抑制其市场需求入手。这需要通过立法渠道，大大提高发送垃圾短信的违法成本。
这显然需要加大对违规者的处罚力度。根据《无线电管理条例》，类似使用“伪基站”干扰通信的行为，可没收当事人设备并处罚款，最高不超过5000元，而这5000元，可能连一个“伪基站”一天的收入都不到。虽然“伪基站”使用者若拒不改正可移送公安机关，但如果不涉诈骗犯罪，公安机关往往只是处以治安拘留而已。
另外，要畅通被骚扰的消费者的维权渠道，让垃圾短信发送者付出沉重代价。在美国，曾有某户外品牌也因广告短信被消费者告上法庭，结果平均每个接到短信者获赔150美元。试想，如果我们的法律也给消费者维权以强力支持，法律允许消费者凭垃圾短信就可向发送商家索赔数百上千元，谁还敢滥发短信。
“伪基站”作为一种新型违法，严重危害通信秩序和用户利益，但现有的法律规定无疑滞后。只有完善立法，提高“伪基站”的违法成本，给民众维权更便捷的渠道，垃圾短信和“伪基站”，自然就没有了生存的土壤。
