陕西省宝鸡市麟游县慈善寺坐落于漆水河南岸，始建于隋文帝开皇年间，唐太宗、唐高宗与武则天时期都有扩建，是隋唐皇帝后妃及大臣在麟游避暑时礼佛的宫廷寺院。寺内山崖上凿有多处石窟，现存有3大窟19龛造像，其造像丰满圆润，刀法洗炼，代表了隋唐时期佛造像的最高艺术水平，1992年被确定为第三批陕西省重点文物保护单位，2001年被国务院确定为第五批全国重点文物保护单位之一。
“佛头”被盗案件发生于1997年8月26日。麟游县公安局接到慈善寺工作人员报警，称当日早晨巡查寺院时，发现寺内一座菩萨造像头部不翼而飞。接警后麟游县公安人员对现场进行勘查，并提取了现场遗留物。但由于当时刑侦技术相对滞后，虽经仔细摸排盘查，本案一直没有取得突破。
宝鸡市打击文物违法犯罪工作领导小组办公室李斌介绍，近些年来，社会舆论一直关注着慈善寺的石佛保护问题。2013年是宝鸡市集中开展打击文物违法犯罪专项活动的第三个年头，在宝鸡市打击办的统一安排下，办案人员再次将当年的现场遗留物进行技术分析，终于取得突破，一名冯姓男子进入警方视线。宝鸡市公安局随后抽调精干警力组成专案组，研究后决定对冯某实施抓捕，冯某9月在家中被抓获。
经审讯，犯罪嫌疑人冯某如实交代了1997年8月伙同其他三人前往麟游县慈善寺盗窃“佛头”的犯罪事实。随后，几名犯罪嫌疑人全部落入法网。专案组查明，冯某等四人当年雇佣一辆汽车来到麟游县慈善寺，破坏寺院石窟门锁进入石窟，用钢凿和锤子将一尊菩萨像的头部凿下后，又顺手将佛龛内的6张床板抬上汽车随后离开。得手后，他们联系中间人将“佛头”卖出，据说半年多时间内“佛头”曾被多次转卖。
目前，“佛头”盗窃案件虽已基本告破，但专案组仍在全力追查被盗“佛头”的下落，希望能让其安然“回家”。
