“区内监管已很吃力”

在王新奎看来，目前中国对投资准入的管理是没有规则的，或者说是碎片化的，国企和民企不一样 ，央企和地方国企也不一样，不同地区的企业也不一样，甚至不同的项目也不一样，比如大飞机项目就有自己的政策。涉及这类的管理规定，大大小小有10多万件。
因此，王新奎认为，负面清单逐步缩短，但并不乐观，“即便是不列到里面，中央部门不同意怎么办？”
《中国(上海)自由贸易试验区总体方案》提出，借鉴国际通行规则，对外商投资试行准入前国民待遇，研究制订试验区外商投资与国民待遇等不符的负面清单，改革外商投资管理模式。对负面清单之外的领域，按照内外资一致的原则，将外商投资项目由核准制改为备案制(国务院规定对国内投资项目保留核准的除外)。
对此，王新奎称，“现在我们的负面清单是以表的形式列出来，太简单。按照国际规则，非服务业一般没有负面清单问题，因为这些投资一般能带来就业和税收，不需要谈判。但是服务部门，凡是投资一定要谈判的。”
因此，王新奎说，自贸试验区的负面清单解决的是国民待遇问题，凡是和国民享受不一样待遇的不行。中国企业需要审批，外资也需要审批，这就是国民待遇。目前解决的是准入前的国民待遇，“并没有非禁即入的概念”。
