记者来到老张所在的天津河西环卫三队宿舍,一间大约40平方米的屋子里,贴墙两侧放置了20多张上下铺。正在屋里休息的一名环卫工人告诉记者,人多的时候这里住了40多人,现在只有不到20来人了。“这里待遇太低,大家都受不了,去别的区环卫上班了。”
一名叫李新华的环卫工人告诉记者,他们每天凌晨3点半左右就要起床,现在工人越来越少,每个人分的地块也变多了。一般一公里的路通扫一遍下来就到早上7点钟,吃过早饭后再继续沿街来回收拾零碎垃圾,直到下午5点。一天工作十几个小时,腰都直不起来。
老张告诉记者,在天津工作多年,单位没有为他们上过社保。“到岁数就回家了嘛,这里没有人给上养老保险,也没有医疗保险,生了病都是自己随便买点药吃,哪敢去医院?”
与河西区的这群环卫工人相比,天津其他区县环卫工人的待遇则相对好得多。记者随机在南开区街头采访了环卫工人周建泽:“我今年46周岁,今年九月份刚从山西临汾被老乡介绍到南开当环卫工人。现在我们一个月2600元,也给上保险,老的年轻的工资都一样。”
专家:相关部门已经涉嫌违法
天津市河西区环卫局宣传科科长欧阳左宁告诉记者,45岁这条界线主要是出自不满十五年不能上养老保险来考虑的,所以45岁以上的人不享受养老保险。

有关专家说,天津市河西区环卫局的这种做法是明显违背我国《劳动法》规定的,政府部门应承当相应的责任,落实好农民工的待遇问题,不应根据年龄或者户籍来区别对待。
北京尚正律师事务所律师崔建华说,按照《劳动法》的规定,从确立劳动关系开始,用人单位就应该给雇佣人员上保险,无关用人的年龄。
天津天允律师事务所律师郑辉说,按照《劳动法》规定,这些工作了十多年的环卫工人是有资格和单位签订无固定期限劳动合同的,用人单位不能随意解聘。而且按照公平合理原则,工龄越长,享受的待遇应该越高。此外,根据户籍所在地分别处理更是完全没有法律依据,涉及户籍歧视。
