国土资源部称，矿产督察是国土资源主管部门聘请专业技术人员，依法对非油气矿业权人法定义务履行情况进行监督检查的行政管理措施，是监督矿产资源节约与综合利用的一项重要手段。而矿产督察员是受国土资源主管部门委托，从事矿产督察工作的专业技术人员，分为国家级和地方级。
根据办法，矿产督察范围重点是大中型矿山、国土资源部颁发勘查许可证、整装勘查区和重要成矿区(带)内的探矿权人。办法同时对督察的次数也给予明确，“对年度工作计划确定督察矿业权人的现场督察次数，每个采矿权人原则上每年2次，每个探矿权人原则上每年1次。”办法说。
办法表示，国家级矿产督察员主要负责重要矿产的大中型矿山和部颁发勘查许可证、整装勘查区的督察工作；市级、县级国土资源主管部门按照省级国土资源主管部门的规定，对督察报告反映的问题依法进行查处。
办法对督察员的权限等提出严格的限制，办法规定，矿产督察员应当依法开展督察，履行督察职责时不得接受被督察矿业权人的任何馈赠、报酬，不得让被督察单位报销任何费用，不得参加被督察单位安排、组织或者支付费用的娱乐、旅游等活动，不得利用职务之便为自己或者他人谋取利益，不得干预、妨碍被督察矿业权人的正常工作，不得在非督察工作场合使用督察证件。
