特邀监察员：反腐的社会力量

2013年11月1日，中纪委监察部在官方网站发布了《<监察机关特邀监察员工作办法>指导规范特邀监察员工作》的消息，自当日起，新的《监察机关特邀监察员工作办法》(下称“新办法”)实施，与此同时，新一届特邀监察员也已亮相。在公众对反腐败的期待下，施行了多年的特邀监察员制度再次备受关注。
作为监察部新聘特邀监察员之一的中国人民大学国际关系学院教授周淑真告诉时代周报记者，本届特邀监察员的选聘不再像往届那样侧重其他党派或无党派人士。“要求特邀监察员凭借优势和特长，发挥咨询、联系、宣传、监督等4个方面作用。”新办法发布后，中纪委监察部网站发布的解读性文章《特邀监察员工作新变化》中如此写道。
24年，从21到3万
广东律师朱列玉是上一届监察部的特邀监察员，亦担任广东省监察厅特邀监察员多年。
朱列玉曾跟随中央的检查组赴西藏、宁夏检查“四万亿”投资的落实情况，也曾跟随广东省的检查组检查粤西的水利工程质量，以及当地农民的补贴发放，不久前他还参与了预出台的《广东省预防腐败条例》的专家咨询工作。
特邀监察员，简单说即纪检监察部门从社会各界聘请的协助开展监察工作的人员。“特邀监察员制度是纪检监察工作的重要组成部分，是依靠人民群众开展反腐倡廉工作的重要途径。自1989年5月监察部建立特邀监察员制度以来，特邀监察员工作在全国各级监察机关逐步推开。”监察部在其官方网站上表示。
这一制度早年曾以“中国共产党领导的多党合作和政治协商制度的重要组成部分”被提出。根据公开信息，1989年5月，监察部印发了《关于聘请特邀监察员的几点意见》(下称“意见”)，建立了特邀监察员制度。同年12月，监察部从民革、民盟、民建等8个民主党派和全国工商联聘请了21位专家、学者，担任了监察部首批特邀监察员。
1991年12月24日，监察部制定了《监察部聘请特邀监察员办法》(下称“旧办法”)，替代了上述意见，规范了聘请特邀监察员的各项工作。这一办法一直沿用20余年，直至近日新办法实施后废止。
从名称中就可以看出，1991年的旧办法规范的对象是监察部，没有涉及地方监察机关，而新办法以监察部令的形式发布，将适用于全国监察机关。公开资料显示，到2009年3月，全国30个省、自治区、直辖市以及94%以上的地市和87%以上的县级纪检监察部门相继聘请了特邀监察员，总数达3万余人。
在2005年的《中共中央纪委监察部关于加强和改进行政监察工作的意见》中，再次提到要进一步健全特邀监察员制度：“建立健全特邀监察员参与和监督监察工作的制度，积极探索新形势下发挥特邀监察员作用的机制和具体途径，充分发挥特邀监察员的参谋咨询、桥梁纽带和双重监督作用。”
公开资料显示，监察部继1989年聘请首批特邀监察员后，分别于1993年3月聘请了28名、2000年1月聘请了34名、2005年12月聘请了36名、2010年12月聘请了40名特邀监察员。1991年的旧办法规定特邀监察员的任期是三年，1996年由三年改为五年。新办法又对此作了调整，规定特邀监察员在监察机关领导班子产生后换届，每届聘用期与本届领导班子任期相同，任期届满后可以续聘，但最多续聘两届。
获聘者的“反腐”专业背景
什么样的人能被聘为监察机关的特邀监察员？从程序上看，根据新办法，首先由监察机关指定的内设机构或有关部门、单位提出初步人选，报监察机关主要负责人审批；然后，监察机关对人选进行考察，研究后决定聘任。
相关文件也规定了哪些人可以成为特邀监察员人选。1991年的旧办法中，除了“政治立场”、“品德作风”等雷打不动的条件外，提出了“热心监察工作，具有一定的政策水平、法律知识和与监察工作相关的专业知识，以及较为丰富的工作经验”等要求。
新办法则列出了七项基本条件，与之前相比，没有大的变化，但增加了“具有中华人民共和国国籍，且没有获得国(境)外永久居留权、长期居留许可”，以及“受聘时年龄一般不超过60岁”，并突出了“在各自领域有较大影响”。根据公开信息，这一届监察部特邀监察员维持上一届40人的规模，但更换了8人。新当选者中绝大多数任职高校或研究机构，专业领域和研究方向与反腐、公共治理有直接关系，如中国政法大学副校长马怀德、北京航空航天大学廉洁教育与研究中心主任任建明、中国社科院政治学研究所副所长房宁、清华大学公共管理学院廉政与治理研究中心副主任过勇。
中国人民大学国际关系学院教授周淑真也是新任的监察部特邀监察员之一，她告诉时代周报记者，此前监察部特邀监察员的人员组成更侧重其他党派或无党派人士；从这一届的情况看，这一倾向不再那么明显。
事实上，马怀德、任建明和周淑真等人此前早已多次以专家身份参加中纪委座谈会，并提出建议。比如，在2012年年底中纪委专家座谈会上，任建明提出建立“廉政特区”—在区内建立独立性更强、权力更大的反腐机构。马怀德提出了制定政务公开法和行政组织法。周淑真则提出官员财产申报应该作为反腐败的突破口尽快实行。
总体来看，新一届40名特邀监察员覆盖了反腐、医卫、法律、教育科研、文化传媒和工商界多个领域；从地域上看，在北京的特邀监察员占了绝大多数。朱列玉因此提出，希望监察部聘任特邀监察员的时候，能给予其他地区特别是西部更多指标，毕竟“不同地区面临的情况不一样”。
值得注意的是，上述40人中还包括一名活跃在网络上、在新浪微博上拥有24万粉丝的网友“窦含章”，其真名叫窦灏洋，身份是中国传媒大学网络舆情研究所总编辑和首席研究员。在与网民的互动中，窦含章将自己的受聘解读为中纪委监察部“重视网民”的表现。
对专业背景的重视在特邀监察员名单中也有所体现，比如中国证券监督管理委员会首席会计师贾文勤，便是上一届和这一届的监察部特邀监察员。
发挥律师和记者的监督特长
除了受邀参加监察部门组织的重点工程检查等活动外，朱列玉告诉时代周报记者，作为特邀监察员，他可以向监察部门反映情况、提意见、提交相关线索，并且特邀监察员还有“专门的信封”。
新的《工作办法》列出了特邀监察员的六条职责，包括“参与行政监察法律法规的研究制定工作，参加监察机关开展的执法监察、效能监察等工作，反映、转递人民群众对监察对象违反行政纪律行为的检举、控告，了解、反映有关行业、领域廉政勤政和作风建设情况，参与宣传监察工作的方针政策，对监察机关及其工作人员履行职责情况进行监督”。
新办法发布后，中纪委监察部网站随后发布的解读性文章—《特邀监察员工作新变化》中写道：“归纳起来，就是要求特邀监察员凭借优势和特长，发挥咨询、联系、宣传、监督等4个方面作用。”
在朱列玉看来，除了专业背景，“接触社会面广”应该是特邀监察员的优势，因此特邀监察员的选择也应强调这一特征，比如在律师和媒体工作者中聘任。
同时也是广东省政风行风评议团副团长的朱列玉表示，利用媒体监督公务员勤政，有更大的宣传和震慑力。他告诉时代周报记者，广东省监察厅就聘请了一线记者担任特邀监察员，将特邀监察员工作和记者暗访拍摄结合起来。
《法制日报》曾记述了连任三届特邀监察员的清华大学建筑系教授王丽方的履职故事：在“5·12”汶川地震后，王丽方跟随监察部的特别检查小组前往灾区监督检查救灾物资使用情况，她发现安置板房建设的计划量与实际需求有出入后，立即提交报告，受到中央重视，最后活动板房安置总量减少了约1/3、节约资金约100亿元人民币，同时，政府直接补助每户灾民自己安置和重建的经费幅度增加了10倍。
新受聘的窦含章则在微博上将自己的职责概括为“做好两个监督，一个是监督网民反响强烈的腐败现象，一个是监督纪检监察系统的反腐败工作；同时做好一个传播，就是传播反腐倡廉正能量，树立大家对反腐败的信心。”
谈到近年兴起的“网络反腐”，窦含章表示，网络爆料案件虽然社会影响大，但在实际反腐败案件中是很少数，“这也提示纪检监察系统，反腐败不仅是查办案件工作，同时也是一项事关民心，事关党和政府声誉的宣传工作，应该加强和网民百姓的沟通，让百姓知道纪检监察系统都在干什么，取得了哪些成果”。
朱列玉告诉时代周报记者，监察部门会及时以电话等形式对自己提的建议或反映的情况进行反馈。
事实上，近年来中纪委监察部显得越来越“透明”和“亲民”，继2009年开通专门的举报网站后，2013年4月结合各大门户网站推出“网络举报监督专区”，中纪委官员主动介绍举报网站；中纪委监察部官方网站2013年9月以来陆续发布了“走进中央纪委监察部”系列报道，甚至网站上刊登的新闻里也跟公众一样，直接称呼原任陕西省安全生产监督管理局局长杨达才为“表哥”。
