东莞裸官巨贪1.7亿元 被判无期

受贿4970万元、约1.2亿元巨额财产来源不明———或为广东最大“蛀虫”的东莞市委原副秘书长吴湛辉，20日被广州中院一审判处无期徒刑。检察机关指控的犯罪事实及数额全部获得法院认定。
判后，吴湛辉当庭未明确是否上诉，表示将考虑再做决定。
法院认定，吴湛辉受贿人民币4970万元，另有9200万港币、3000万人民币的巨额财产来源不明，法院一审判决：吴湛辉犯受贿罪，判处无期徒刑，剥夺政治权利终身，并处没收财产人民币500万元；犯巨额财产来源不明罪，判处有期徒刑10年。决定执行无期徒刑，剥夺政治权利终身，并处没收财产人民币500万元。追缴受贿及巨额财产来源不明罪的全部非法所得，上缴国库。据悉，案发后，吴湛辉先后多次退赃，并出让房产直至全额退赃。
1.7亿的涉案金额，仅被判处无期徒刑，是否判轻了？广州中院相关人员20日向记者表示，对吴湛辉犯巨额财产来源不明罪判刑10年“已经到顶了”。据了解，相对而言，巨额财产来源不明罪属于刑法中的轻罪，最高刑期为10年。
判决指出，吴湛辉在被调查期间，主动到案且向联合调查部门检举时任东莞市环保局局长袁绍东收受东莞市环保局下属的工业废物处理站实际经营者赖洪中巨额贿赂的情况。经查证属实，有重大立功表现。
资料显示，2007年3月，袁绍东从东莞市政府副秘书长去职，接替吴湛辉的东莞市环保局局长一职。2012年9月，袁绍东被省纪委调查，因收受东莞两家公司老板的贿赂共870万元，袁绍东今年6月18日被广州中院一审判刑14年。
案件回放
巨资购置香港豪宅
法院查明，2006年4月，吴湛辉通过地下钱庄转账1600万元港币，购买位于香港罗便臣道9号荟萃苑10楼B座及其4楼2号车位。2011年6月，他再次通过他人的地下钱庄转账7600万元港币，购买位于香港黄麻角道88号富豪海湾B25栋屋及其两个停车场。2007年上半年，吴湛辉出借人民币3000万元给赖洪中用于资金周转，后来收回。
与商人平分利润
吴湛辉与东莞市恒泰环保设备有限公司负责人赖洪中约相识于2003年上半年。当时吴湛辉是东莞市环保局局长，而赖洪中是曾任东莞市监察局副局长赖鸿就的哥哥。
吴湛辉称，当时赖洪中有意承包该局下属的工业废物处理站，并许诺如获承包，将与其平分利润，他表示同意。在其帮助支持下，该处理站从2003年10月开始由赖洪中承包经营。2005年3月至2007年间，赖洪中按约共向吴湛辉支付了2150万元好处费。
2006年年初，吴湛辉提出由其兄吴湛林与赖洪中的公司签订虚假合作协议，以掩盖赖洪中给其好处费的事实。2006年12月，在吴湛辉的帮助下，赖洪中再次以恒泰公司的名义承包经营东莞市环保局下属的工业废物处理站，仍约定平分利润。之后，赖洪中按约每月支付人民币50万至60万元不等给其，自2008年至2012年3月共支付2820万元。
也即，自2003年至2012年间，吴湛辉收受赖洪中贿送的钱款共4970万元。
行将提拔时“出事了”
吴湛辉1967年7月出生于东莞市中堂镇，暨南大学社会管理硕士研究生毕业。
曾先后担任东莞石排镇镇长等职。2003年至2007年，任东莞市环保局副局长、局长等职。2007年3月至2008年8月，任东莞市政府秘书长等职。2008年9月至2012年2月，任虎门镇委书记。
2012年2月起，任东莞市委副秘书长。2012年10月，因涉嫌严重违纪被广东省纪委调查。
吴湛辉被宣布接受调查后的次月，时任广东省委副书记的朱明国接受羊城晚报记者专访时称：“(上级)本来准备提拔他的，被举报经查实，才发现吴已是‘裸官’”。
而一名曾在吴湛辉手下工作的东莞知情人士则对羊城晚报记者表示，吴湛辉比较有才能，当时拟被提任为东莞副市长，差不多要安排位置了，结果一查是裸官，“就出事了”。
