上海市环保局局长张全昨天代表市政府做了修订草案说明。张全表示，上月市政府公布的《上海市清洁空气行动计划(2013-2017)》明确到2017年，上海空气质量明显改善，重污染天气大幅下降，PM2.5年均浓度在去年基础上下降20%。此次的修订草案专门针对PM2.5污染的防治，制定一系列制度措施。
草案亮点
● 防污染标准高于国标
为从源头上降低机动车、船等污染排放，新草案规定，市质量技术监督部门可根据实际情况，会同有关部门制定严于国家标准的车、船、非道路移动机械燃料地方质量标准。首次对非道路移动机械排放污染物进行规范，规定污染物排放不得超过国家和本市规定的排放标准。
● 三年后煤炭消费负增长
新草案增加了控制能源消费总量规定，通过逐步提高接受外输电比例、增加天然气供应，加大非化石能源利用强度等措施替代燃煤，力争到2017年实现全市煤炭消费总量负增长。
● 存量高污染企业须调整
根据新草案，严重污染大气的产业成为被严格控制对象，相关部门制定本市产业机构调整指导目录时，应根据本市大气环境质量状况，将严重污染大气的产业列入禁止或者限制发展的范围。新建排放大气污染物的产业项目，应安排在城乡规划确定的工业园内。另外，存量的高污染企业必须自行调整或者淘汰，否则由政府责令其停业、关闭。
● 机动车排黑烟最高罚500元
新草案明确，在上海行驶的机动车不得排放明显可见的黑烟，行驶中的机动车排放明显可见黑烟的，由公安交通管理部门暂扣车辆行驶证，责令限期维修，可处二百元以上五百元以下罚款。
● 居民楼不得新建饮食店

新草案还规定，列入大气污染物排放重点监管单位名单的，主要大气污染物排放量超过总量控制指标的，大气污染物超标排放等的单位，应按环保部门要求，通过报纸、网站等定期公布大气污染物的排放种类、数量、浓度等单位环境信息。
● 制订重污染天应急方案
新草案规定，本市建立重污染天气预警机制。市环保部门应会同市气象等部门根据大气环境质量状况，拟订本市空气环境质量重污染天气应急方案，报市政府批准后实施。大气受到重度或严重污染的，市政府应根据应急方案，采取暂停或者限制排污单位生产、停止易产生扬尘的作业活动、限制机动车行驶、暂停燃放烟花爆竹等应急措施，并向社会公告。
● 污染执法实行双罚制
新草案规定了双罚制，对发生环境污染事故或者被处以五万元以上罚款的严重环境违法行为，除对单位进行处罚外，环保等有关部门还可以对单位主要负责人和有关责任人处五千元以上十万元以下的罚款。
