国务院总理李克强11月20日主持召开国务院常务会议,通过关于依法公开制售假冒伪劣商品和侵犯知识产权行政处罚案件信息的意见,决定整合不动产登记职责。
会议指出,公平竞争是发展市场经济的基本要求。当前我国正处于改革发展和经济转型升级的关键时期,提高产品质量、实施创新驱动,至关重要。依法对假冒、侵权行政处罚案件实行信息公开,接受人民群众监督,是促进质量提升和产业升级、增强消费者信心、保护知识产权、鼓励创新创业的一剂“良方”,有利于维护公平竞争的市场秩序、保护消费者权益、提高执法公信力。罚劣是为了奖优,要让恶意造假制劣特别是损害人民群众生命健康的违法者付出高昂代价,让守法经营者路路畅通、受到褒奖,让广大科技人员大胆创新、放心创业。
会议要求,要把假冒侵权行政处罚案件信息公开作为政府信息公开的重要内容。除涉及商业秘密和个人隐私外,适用一般程序查办的假冒侵权行政处罚案件信息应当主动公开。行政执法机关要在作出处罚决定或处罚决定变更之日起的规定时间内,依法公开案件信息,包括违法违规的主要事实、处罚种类、依据和结果等,做到公开透明,并及时回应社会关切。将行政处罚案件信息纳入社会征信体系,使假冒侵权者因信用不良“处处受限”。行政执法机关要严格依法裁量、履行职责。各级政府要加快建立健全管理、考核等制度,加强监督检查。对不履行信息公开义务、不及时公开或更新信息内容、违规收取费用等行为,要坚决纠正并严肃问责,让执法行为受到社会监督。
会议指出,整合不动产登记职责、建立不动产统一登记制度,是国务院机构改革和职能转变方案的重要内容,也是完善社会主义市场经济体制、建设现代市场体系的必然要求,对于保护不动产权利人合法财产权,提高政府治理效率和水平,尤其是方便企业、方便群众,具有重要意义。
会议决定,将分散在多个部门的不动产登记职责整合由一个部门承担,理顺部门职责关系,减少办证环节,减轻群众负担。一是由国土资源部负责指导监督全国土地、房屋、草原、林地、海域等不动产统一登记职责,基本做到登记机构、登记簿册、登记依据和信息平台“四统一”。行业管理和不动产交易监管等职责继续由相关部门承担。各地在中央统一监督指导下,结合本地实际,将不动产登记职责统一到一个部门。二是建立不动产登记信息管理基础平台,实现不动产审批、交易和登记信息在有关部门间依法依规互通共享,消除“信息孤岛”。三是推动建立不动产登记信息依法公开查询系统,保证不动产交易安全,保护群众合法权益。会议要求,各有关部门要加强对各地职责整合工作的指导,加快清理相关规章制度,做好有关事项的整理交接,确保不动产登记职责整合工作有序、平稳推进。
会议强调,要按照全面深化改革的要求,针对薄弱环节,运用法治思维和方式,通过建章立制,一步一个脚印推动构建公平竞争的市场环境。各级政府要在这方面下功夫、出实招,为经济持续健康发展和社会不断进步提供有力保障。
