  84岁的茅先生在18日发布了这条微博后,引发不少网友热议,截至发稿时,此条微博已被转发2100余次。昨天上午,北京青年报记者联系上茅先生,据他介绍:“18日上午10点40分左右,我在昆明长水国际机场办理业务,准备搭乘一家航空公司的航班返回北京。但是办理登机牌之前,我被要求填写一张单子,单子上的内容大致意思是如果在飞机上出了意外,航空公司没有责任,我觉得这个毫无道理。”


  茅先生表示,这张单子是航空公司工作人员主动给他的,并且告诉他:“公司规定了80岁以上乘客就要填单子。”茅老回忆:“以前我也遇到过这样的事情,如果不填写那张单子,就无法换登机牌,我并不清楚这样的规定是由谁制定的。”据他说,这张单子填写后由航空公司工作人员拿走了。


  昨日,北青报记者致电茅先生所提到的这家航空公司客服,相关工作人员表示,航空公司对乘客没有年龄限制。若老人身体健康,可直接办理购票、检票、登机等手续。若家人感觉有隐患,可向医生开个健康证明再登机,老人登机前无需填写任何“申请书”。


  昆明长水国际机场客服人员则表示,不同航空公司对70岁以上乘客有不同要求。“各家航空公司要求不同,我们要依据公司的要求来定。若老人生病或身体状况不好,机场安检部门可能会拒绝老人登机。”

  今年75周岁的李老先生,几年前乘坐一家航空公司的班机从外地回北京时也有类似的遭遇。“登机前我也被要求签署一张单子,但是当时我坚持拒绝,我觉得航空公司这样做并不合理,记得那次我在机场折腾了好一会儿,最后才登上了飞机。”


  而这种现象也出现在了北京。北青报记者在以乘客身份致电咨询南苑机场时,相关客服人员表示,70岁以上老年乘客必须开具地方三级甲等以上医院盖章的健康证明,证明老人的心脏、心血管及血压等是健康的,才能乘机。若老人无法出示健康证明,则必须在机场现场签署“免责书”。


  老年乘客签了这个“免责书”后,“老人因自己身体状况在乘机时出现任何问题,就与我们没关系了。”但当北青报记者问询能否由他人代领免责书时,机场客服人员表示一定要老人在换登机牌时签,不能提前领取或由他人代取。


  不过,这份协议书并非是机场免责,针对的还是航空公司。


  据了解。南苑机场由中国联合航空有限公司独家运营,北青报记者致电该公司客服部得到以下答复:70岁以下乘客按一般旅客接待,70岁至80岁之间的老年乘客需成人陪同乘机,80岁以上老人除成人陪同外,还需签署“免责协议书”。

  超过70岁的老人成了“特殊”乘客


  北青报记者在搜索时发现,一些航空公司将“老年旅客”纳入“特殊乘客”范围,并在备注中标明:“我们要求特殊旅客购票时应提供相应证明并办理特殊旅客运输手续,如您未能遵守规定,我们有权拒绝运输。”北青报记者随后致电多家航空公司客服咨询。


  在春秋航空公司的官网上,北青报记者看到该公司对70岁以上乘客有如下规定:70岁(含)以上的老年旅客购票,需填制《特殊旅客运输申请表》、提供180天内的有效乘机证明,或180天内医疗单位盖章和医生签字的《体检证明》。


  该公司客服人员表示:“年纪已经超过70岁的乘客,必须携带半年内的乘机证明,包括机票和登机牌。若半年内没有登记记录,则必须携带国家正规医院开具的健康证明,检查项目包括心电图、心率数值、血压数值和呼吸道检查。70岁及以上乘客必须提供至少一项才可购票。”但该客服同时表示,此项规定不知道是谁制定的,她们只负责告知旅客。


  不过并非所有的航空公司都将老人列为“特殊乘客”。海南航空工作人员明确表示,“我们没有《特殊旅客搭乘协议》,更不会强制性要求旅客必须填写签字,海航只对身体健康状况不适应乘机的旅客有相关规定,对于年龄没有限制。”


  南方航空公司国内航线客服表示,南航没有硬性规定乘客的年龄限制。若老人身体健康,即可按照一般乘客接收,若老人无人陪同,可向南航申请“老人迎送服务”。若老人需要在空中得到特殊照顾,需在航班起飞前72小时内,于始发地向南航申请。

  乘机人年龄没有上限 “免责协议”未必合法


  根据《中华人民共和国民用航空法》第一百二十四条规定,因发生在民用航空器上或者在旅客上、下民用航空器过程中的事件,造成旅客人身伤亡的,承运人应当承担责任,但是,旅客的人身伤亡完全是由于旅客本人的健康状况造成的,承运人不承担责任。


  而民用航空局颁布的《中国民用航空旅客、行李国内运输规则》第三十四条规定,无成人陪伴儿童、病残旅客、孕妇、盲人、聋人或犯人等特殊旅客,只有在符合承运人规定的条件下经承运人预先同意并在必要时做出安排后方予载运。但是该规定并未对乘机人年龄上限做出限制。


  中国政法大学民商经济法学院李显冬教授表示,航空公司对乘客有告知义务。对于特殊乘客,如孕妇、老年人等乘客,自身条件不适宜乘坐航班的,航空公司须告知其航行的危险性。航空公司尽到了告知义务,就没有过失,签不签这张“免责单”其实没有区别。但若没有履行告知义务,航空公司就要承担相关责任。


  李显冬表示,若老人不签“免责书”而被拒载,可以要求航空公司出示相关法律条文,证明此种文件符合国家法律法规,若中国法律法规中没有相关规定,那就属于违法行为。
