  草案修改稿指出,所称行政审批,是指行政机关根据公民、法人或者其他组织的申请,进行审查,依法赋予其特定权利、免除其特定义务或者准予其从事特定活动的行为,包括行政许可和非行政许可。如何界定行政审批和非行政许可审批的内涵及范围,成为了会上不少常委会组成人员关注的焦点。


  部分专家认为,行政许可按照《行政许可法》的规定执行,非行政许可审批的设定依据则相对宽泛,部委规章、政府规章和政府规范性文件均设置非行政许可审批,造成非行政许可审批事项庞杂、管理与监督较为混乱,有必要通过立法进行规范管理和监督。


  另一方面,也有与会专家认为,不适宜通过立法将行政审批区分为行政许可和非行政许可审批,因为二者的内涵和外延既有区别又有交叉,难以明确进行区分和界定,且行政许可的原则并不一定适用于非行政许可审批,建议两者分别制定相关规定进行规范。


  对此,省人大常委会法工委认为,针对目前非行政许可审批存在过多过滥、实施不规范等问题,建议将非行政许可审批纳入本条例进行规范,明确行政审批包括行政许可和非行政许可审批。

  审批设定权限上收还是下放?草案修改稿规定:本省设定行政审批,由地方性法规或者省人民政府规章规定。


  在法规论证期间,大多数立法专家和实务工作者认为,将行政审批限定为本省地方性法规和省政府规章设定确有必要,符合从严控制新增行政审批的要求,可以防止行政审批过多过滥。


  但也有不少专家对其可行性存在疑问。专家提出,可否允许较大市政府规章设定行政审批,一方面较大市的政府规章制定程序比较严格规范,以行政许可法的要求来规范行政审批的设定似乎过于苛刻;另一方面,一些地方政府优惠政策的审批,特别是地方政府对其政府资金的使用和管理,上升至省的层面进行规范缺乏政策的灵活性,实际操作方面存在一定困难。


  对此,省人大常委会法工委则同意从严控制行政审批的设定,因此建议保留草案第五条关于行政审批由本省地方性法规和省政府规章设定的规定。


  另外,有个别专家认为,在清理行政审批事项时应当给地方留个出口,通过制定政府规章或者规范性文件保留部分确有需要实施的行政审批。但省人大常委会法工委表示,经研究,由较大的市人民政府规章或者各级人民政府及其有关部门规范性文件设定的行政审批事项与本条例存在冲突的,应当进行清理,不符合本条例规定的,应当停止执行。
