  两个多月前,《法制日报》视点版报道了湖北省鄂州市多个商品房项目突破规划审批违法建设的情况。时隔两月余,政府部门对违法建设的处理进展如何?记者再赴鄂州实地调查,却发现背后还隐藏着扑朔迷离的内情……

  9月3日,《法制日报》视点版报道了湖北省鄂州市多个商品房项目突破规划审批违法建设的情况,引发社会普遍关注。报道刊发后,鄂州市有关政府部门表示,将加大力度查清事实、整顿有关违法建设项目。


  《法制日报》记者近日再赴鄂州实地调查处理情况,采访政府部门与涉事商品房开发商,追问违建项目“疯长”背后原因。


  政府部门


  行政处罚告知书不得复印拍照


  9月3日,《法制日报》记者调查核实发现:鄂州市永森房地产开发有限公司开发建设的竹林广场项目、湖北巨源房地产开发有限责任公司开发建设的南国名门项目、鄂州市金旺房地产开发有限公司开发建设的中天大厦项目、湖北德立房地产开发有限公司开发建设的莲花中央广场住宅楼项目等4个项目不同程度存在违法违规情况。


  10月16日、11月6日,《法制日报》记者先后两次到鄂州市采访。


  10月16日,鄂州市规划管理局办公室主任何仲斌称,该局法制科等部门正在调查,要核查实际面积,发整改通知书,看安全建筑、安全结构方面有无问题,再来确定违法性质。


  21天后,鄂州市规划管理局分管法制科的陈副局长、法制科科长卢咏华一起介绍了有关情况。


  陈副局长介绍说,经初步核查,《法制日报》报道的4个项目违法情况基本属实;目前该局已依法启动了行政处罚程序,分别对竹林广场、莲花中央广场、中天大厦下达了《行政处罚告知书》;因南国名门的3栋别墅属于无规划建设,已按照职责划分移交给凤凰街道办事处处理。


  《法制日报》记者要求查看《行政处罚告知书》文本,陈副局长面露难色。在记者多次要求下,他同意提供《行政处罚告知书》原件,但不允许记者复印或拍照。


  《法制日报》记者看到,3份《行政处罚告知书》文号分别是“鄂州规罚告字[2013]第××号”,其中中天大厦是08号、莲花中央广场是09号、竹林广场是13号。


  3份《行政处罚告知书》显示:因中天大厦涉未批先建,鄂州市规划部门拟责令开发商补办手续、补交规费并罚款,合计1228776元;对竹林广场,规划部门拟责令开发商补办手续、补交规费并罚款,合计4645827元;对莲花中央广场,规划部门拟没收违建面积的违法收入并处以造价百分之十以下的罚款。


  对南国名门的3栋别墅,陈副局长说,调查发现其没有办理任何规划手续,“是必须要拆掉的”;其所占土地归三方,分别是南国名门项目的一部分土地、庙脚洪公寓项目一部分土地、凤凰街道办事处洋澜村7组的集体用地。


  卢咏华介绍,按照职责划分,没有经过规划审批建设的房屋处理由街道办事处所属的城管中队负责拆除。


  10月16日,《法制日报》记者曾实地查看南国名门3栋别墅,与第一次采访时不同,三栋别墅门前分别挂上了“凤凰街办洋澜村七组党员群众活动中心”、“鄂州市神舟物业管理有限公司”、“湖北巨源房地产开发有限公司(南国名门项目开发商)”3块铭牌。


  工商登记资料显示,鄂州市神舟物业管理有限公司成立于2011年8月22日,其法定代表人是夏四平,经营场所位于鄂州市凤凰街办洋澜村7组。


  开发商称


  得到市政府会议纪要允许


  面对政府部门即将开出的巨额罚款,开发商们又作何反应?


  《法制日报》记者先后联系了鄂州市金旺房地产开发有限公司法定代表人杨金开、湖北德立房地产开发有限公司法定代表人张伟、鄂州市永森房地产开发有限公司法定代表人王贤银、湖北巨源房地产开发有限责任公司法定代表人杨在武等人。其中,王贤银手机一直关机,记者发送短信也没有获得回复。


  与第一次主动接受采访不同,10月16日,南国名门开发公司负责人杨在武在电话中表示,自己不想再多说什么,政府部门该怎么处理就怎么处理。


  在10月16日、11月6日两次接受《法制日报》记者电话采访时,鄂州市金旺房地产开发有限公司(中天大厦项目开发商)法定代表人杨金开都表示自己加层建设实在是迫于无奈,政府罚钱让自己感到“很冤”。


  杨金开说,2009年,自己的公司拿下了中天大厦所在地的城中村改造项目批准文书(拆迁许可证),但随后鄂州市政府领导频繁更换,城中村改造计划被暂缓,土地证、规划许可证和施工许可证迟迟办不下来;2年没有动静,老百姓的房子已经拆了,很多拆迁户找公司要房子,没办法,公司才冒险开发。


  杨金开表示,国土、规划等多个部门都要“罚钱”,一罚就是上百万,“交了罚款才给发证”。


  这一圈折腾下来,杨金开说,公司算了一下,难以赚到钱,就加盖了两层,希望能借此“少赔点”;“这个项目我们铁定是要亏钱,几百万吧”。


  《法制日报》记者打通湖北德立房地产开发有限公司法定代表人张伟的手机,对方否认自己是“张伟”,但也对他们开发的莲花中央广场住宅2号楼“长高”给出了解释。


  这位男性负责人说,当初,为满足消防需要,政府把凤凰南路(临近莲花中央广场项目所在地)进行拆迁,鄂州市政府会议纪要同意把凤凰南路拆迁户安置还建到莲花中央广场2号楼,为了做到容积率平衡而建成高层。


  “现在你们把这事报出来,政府要罚我们款。”10月16日,上述负责人说,他们已收到规划部门下发的行政处罚告知书,正在通过律师提出行政复议。


  监察部门


  查处违法建设管理体制不顺


  到底是什么原因导致违法建设不能及时发现?有关部门为何没有及时制止而任由其“疯长”?《法制日报》记者10月16日采访了鄂州市纪委监察局执法室主任王德友。


  王德友说,9月3日《法制日报》报道刊发后,分管此项工作的鄂州市副市长汪继明当晚即组织监察、房管、规划、城管、外宣等部门召开会议,形成了4条意见:吸取教训,分析原因,查找症结;厘清职责,解决职能交叉问题;严肃查处有关违建项目,出重拳整治;完善有关工作制度。


  9月9日,鄂州市纪委监察局以“鄂州市工程建设领域突出问题专项治理工作领导小组办公室”名义向市规划局下发督办通知,要求他们迅速查处有关违建情况,并与市规划局局长李全交换意见,处理速度明显加快。


  王德友透露,《法制日报》记者采访报道前,鄂州市治工办就曾对全市开工建设的30多个商品房项目进行了调查,并在今年4月份形成了一份调查报告,调查发现全市对违法建设的行政执法存在很大问题——规划监察支队隶属于市城管局,但未从制度层面厘清职能,规划违法的执法权仍在规划部门,城管局接收了队伍但无执法权力,执法队伍与执法权分离,“两张皮”削弱了查处力度。


  记者了解到,2008年8月18日,鄂州市政府常务会议审议通过了《鄂州市控制和查处违法建设办法(试行)》,并于当月20日起正式施行。


  办法明确,街道办事处和乡镇人民政府是其辖区范围内控制和查处违法建设工作的责任主体;市城管部门所属市规划执法监察大队接受市规划部门的委托,负责查处法人或其他组织未按建设工程规划许可证的规定进行建设的违法行为;市规划部门是违法建设查处的法定行政执法主体,依法委托市规划执法机构行使城市规划管理方面的行政执法权,负责制发相关法律文书,协助做好违法建设的甄别、定性工作。


  “违建这一块儿,在现行的编制管理体制下,区、乡镇等基层单位并没有城管等法定机构,规范其执法行为必须引起高度的重视。”王德友说。
