11月20日，北京市第十四届人民代表大会常务委员会第七次会议，审议了《北京市动物防疫条例(草案)》。根据该草案，携带训练合格的导盲犬等工作犬乘坐公共交通工具将不受限制。
据媒体报道，北京市法制办称，今年6月至7月送审稿向社会公开征求意见期间，收到的264条有效意见中，提及“允许携带导盲犬乘坐公共交通工具”的最多。
此前，盲人陈燕和她的导盲犬珍妮被北京地铁拒绝的新闻曾多次见诸媒体，并引发舆论热议。自陈燕2011年得到导盲犬珍妮后，即便出示相关证件，部分北京地铁线路也一直将珍妮“拒之门外”。

老问题
两法规冲突适用范围明显不同
北京公共交通工具拒绝导盲犬的依据是2003年出台的《北京市养犬管理规定》(以下简称《规定》)，其中要求养犬人不得携犬进入公共场所，也不得携犬乘坐公共交通工具。
截至记者发稿时，没有得到该规定将修改或废止的消息。
记者查询该条例，发现此前《条例》的送审稿中，明确该《条例》的适用范围是“本市行政区域内的动物防疫及其监督管理活动”，而《规定》则写明“本市行政区域内的机关、团体、部队、企业事业单位、其他组织和个人，均应当遵守本规定”，显然后者的适用范围大于前者。
其中，《规定》是由当时的人大常委会审议通过的，而《条例》则仍在人大审议中，未来如果可能也是由人大通过。
专家意见
特殊优于一般导盲犬应该能进
中央民族大学法学教授刘景一认为，同为地方法规，在存在冲突的情况下，具体施行仍应遵照导盲犬可以乘坐公共交通工具的规定。这也符合法律领域特别法优于一般法的原则。
他同时表示，在立法过程中，相关部门应检索此前的条文，对存在冲突的地方一并做出修改，否则会给现实生活造成很大不便。
明科律师事务所郑洪涛律师表示，根据后法优于前法的原则，应该理解为可允许导盲犬乘坐公共交通工具。即便这是一部关于动物防疫的法规。
但他也认为，具体执行中可能会有不便，比如由哪个部门具体落实，应该进一步细化。
