“最近一年多，我们已在上海监测到40多个发送点。 ”一位移动内部人士昨向本报记者独家透露，他们已将上述信息向无线电管理局和警方汇报。但无奈的是，在现有立法缺失下，“伪基站”的肆虐情况难以遏制。

神秘的“伪基站”究竟是什么？

“伪基站往往会放在汽车的后盖里，还需要专门的蓄电池配合供电。另外，还要一台笔记本电脑通过车后座的座椅缝隙与之相连，再通过一根天线将信号发射出去。 ”刘渊明说，这样一套设备完全藏在车内，天线也和车载无线收音机鞭状天线非常像，看不出蹊跷。
一旦设备启动，伪基站的威力会迅速辐射到半径一百多米的范围，将过往路人的手机信号“吸干”。 “如果边走路边打电话，一旦进入范围，通话就会迅速掉线，短信收发也全部失败。 ”刘渊明说，相当于运营商的网络被完全屏蔽，取而代之的是“伪基站”发射的网络。
由于目前GSM网络采用单向鉴权，仅有网络对用户终端鉴权，用户终端对网络不进行鉴权，伪基站的广播网号、广播频率和现网相同会自动申请进网，用户手机很快会被伪基站所抓取。随后，各种诈骗、垃圾短信就会源源不绝推送。
“而且号码可以随便换，无论是110、120等紧急号码，还是运营商、航空公司、银行等公共大号，甚至是警察局号码，都可以任意显示，很多不知情的用户都会被唬住。 ”刘渊明说。
40多个伪基站一半为今年10月新增
大量愤怒用户的投诉，让运营商警惕。 “今年年初，这种投诉占比还比较低。9月份，上述投诉已占30%左右，短短一个月后又暴增至50%以上。 ”上海移动一位内部人士表示，由于伪基站不通过运营商网络推送信息，导致他们既不能拦截、也很难监控。 “只有当某个区域发生网络异常，或产生大量用户投诉时，才能顺藤摸瓜去排查。 ”
刘渊明团队向记者提供的数据显示，从2012年初至今，上海约有40多个“伪基站”的发送点，其中一半是今年10月新增的。 “用户手机受影响的时间有多长，取决于伪基站车是停在路边还是在行驶。 ”刘渊明说，就算进入伪基站只有短短几秒，也会迅速被控制。 “但很少有人会在收到短信的瞬间去移开目光关注手机信号，加上很快会恢复，这笔账往往都被记到了 ‘被山寨’的企业或机关头上，用户也更容易受骗。 ”
伪基站运营者：10天连本带利赚回来了
弄一个“伪基站”需要多少钱？一位运营商人士表示：“几乎几天就能回本。 ”
刘渊明说，几个月前，他曾配合公安部门抓到一个伪基站运营者。对方供述称，自己买了两套设备总价值9万多元，每天开着车在市中心到处跑，10天就连本带利赚回来了。 “伪基站有一条灰色产业链，有需求方派任务就有人接单。 ”上述运营商人士透露，伪基站系统比较完备，短信发送在后台都有记录，方便结算佣金。
在一次和主管部门的沟通会上，刘渊明直接打开淘宝网，输入“圈地短信”关键字后，出现一大片搜索结果，各种伪基站价格从3万元到8万元不等。 “卖家很狡猾，不会傻到直接用‘基站’、‘群发’等关键词，以防被抓住。 ”
不过，或许是由于媒体近期不断曝光，记者昨天再次登录淘宝搜索时，绝大多数商家已销声匿迹，只余下一些卖天线的店铺。 “这是一款天线，不是什么设备。本公司只有天线，不做设备。”一位卖家闪烁其词地表示，“设备”暂时无货。
运营商：希望主管部门拿出立法措施
经过央视曝光后，全国各地对“伪基站”的执法行动已开始。但令运营商有苦难言的是，尽管频频整治，但实际效果反而是在火上浇油。
根据公开报道，今年8月至10月，广东省相关部门联合当地运营商，启动打击利用伪基站设备实施违法犯罪专项行动以来，全省共抓获103人，刑拘99人，逮捕41人，缴获伪基站设备70套。
根据中国移动湖北公司的通报，本月12日已查获一处位于孝感闹市区某酒店内的伪基站，最终在该客房内成功抓获4名嫌疑人，查获1台伪基站、2部笔记本电脑、10部手机及21张银行卡，该伪基站已发出近20万条 “办假证”等短信。
“关键问题在于，公安抓了人之后，拿他们怎么样？ ”一位不愿具名的运营商人士说，由于现行法律法规没有任何一条能给“伪基站”定罪，最多抓进去关个15天就得放人。
“我们也向无线电管理局举报过，对方最多只能没收设备，别的也做不了。这让运营商比较头疼，因为这会助长对方气焰，让他们觉得犯罪成本低。没收设备？再搞几台几天就赚回来了。 ”上述人士私下向记者吐槽称。
就算伪基站适用者不构成侵权，那为何不直接去举报生产厂家呢？ “运营商并不具备溯源的能力，我们只能配合警方排查，并不掌握伪基站的销售和制造渠道。 ”刘渊明说，就算抓获使用者，对方也只交代得出交易地点，对上游情况也不尽了解。在重重因素的制衡下，对于来势汹汹的伪基站，运营商站在两难的境地。
当记者问及为何不向用户推送一些安全提醒时，上述匿名人士坦言这是“自找麻烦”。 “伪基站未使用运营商网络，我们不清楚具体哪些用户被卷入其中。一旦群发，一些未遭遇过伪基站的用户会认为我们在骚扰他，反过来投诉运营商发垃圾短信。今年工信部在大力整治垃圾短信，每个运营商都背指标，这种行为不等于‘自黑’吗？ ”
目前，部分第三方安全软件已经开启针对伪基站短信的过滤功能，但运营商方面依然慎重。 “解决问题的根源，仍在于主管部门拿出相应的立法措施。 ”上述人士说。
