身份保密
建立工作档案矫正小组共同帮教
东坡司法所辖区共有多名社区服刑人员，黄涛是其中一名。“这些社区服刑人员基本都有工作，他们的身份是保密的，这样他们才能正常生活，我们也能有效监管。”东坡司法所所长胡晓安说，社区矫正人员要受到严格管制，比如不得擅自离开居住地，每月按时到司法所报到，上交书面思想报告等等。司法所给每名社区服刑人员建立了工作档案，还组织了社区、志愿者、社区服刑人员的家属等成立矫正小组，共同监管、帮教社区服刑人员。
去年2月，最高法、最高检、公安部、司法部联合制定了《社区矫正实施办法》；今年1月1日，新刑诉法生效，社区矫正作为刑罚执行，其执法主体由公安机关变成司法行政机关。在这些时间点前后，东坡司法所的社区服刑人员陆续多了起来。“工作量倍增，今年还新招了一个工作人员，50%的精力都花在这上面。”胡晓安说。
管理方式
两三人管几十人实施手机定位监管
《社区矫正实施办法》明确了司法所的日常管理职责之后，全省许多司法所都面临人手不足的问题。
省司法厅统计数据显示，去年我省新增社区服刑人员2000多人，今年又新增7000人，目前共有36400多人。主管全省社区矫正工作的司法厅工作人员说，全省有10个市州社区服刑人员在1500名以上。自去年9月全省实施社区矫正社会调查评估制度以来，已办理案件2000多件，简单测算，这些工作需要2万多人次进行走访。再加上追查、收监押送等非常规、不确定工作量，社区矫正监管任务越来越繁重。
成都市司法局工作人员说，有些司法所只有两三个工作人员，却要管理几十名社区服刑人员，压力非常大。为缓解人员不足的压力，成都市进一步加大了信息化建设力度，并开始实施“三网合一(电信、联通、移动)”的手机定位，同时给全市每个司法所都配备一个能适时监控的管理终端。

今年3月，黄涛因为行贿被判缓刑。此前，他已经被看守所关了两个月。法院判决生效后，他作为社区服刑人员，由司法机关对其实施矫正，并在居住地接受社区服刑。此后，他必须遵守各项监管规定，如每月到司法所汇报思想、接受教育、参加社区公益劳动、手机24小时开机、不得自行离开居住地等，否则就有可能因违反监管规定而被收监执行。
“我还在干以前的工作，但从没离开过成都。随身带着充电器。”黄涛说，他还参加了街上捡烟头等义务劳动。虽然受到种种限制，黄涛还是觉得，和看守所的日子比起来，自由了很多。

司法厅工作人员预计，未来5年内社区服刑人员的数量将快速增长。社区服刑人员将成为社会管理中一个数量庞大、身份特殊的人群。据了解，刑法修正案(八)明确了对判处管制的、缓刑考验期的、假释考验期的犯罪分子依法实行社区矫正。新修改的《刑事诉讼法》虽然也对社区矫正作了相关的规定，但社区矫正内容没有具体化，操作性不强。据了解，《社区矫正实施办法》作为最详细、最权威的规范性文件，对社区矫正的适用范围和任务以及各政法部门在社区矫正工作的作用都作了明确的规定。但是，它仅仅属于司法解释性质的文件，其法律地位与社区矫正的重要性不协调。记者获悉，今年7月，《社区矫正法(草案)》，已经提请国务院审议。
